ORDINANCE NO
AN ORDINANCE AMENDING RESIDENTIAL GARBAGE COLLECTION FEES
IN ACCORDINACE WITH SECTION 12.5-842 OF THE CITY CODE;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
OTHER ORDINANCES, PROVIDING A SEVERABILITY CLAUSE, PROVIDING
A SAVINGS CLAUSE, AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Sec. 12.5-842 of the City Code (the Code) provides that the City Council
shall by ordinance set rates for solid waste collection services; and

WHEREAS, the Code provides that the City Services Director shall charge customers
rates pursuant to such schedules,
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS, THAT
SECTION 1
The following residential garbage collection fees are adopted as provided for in Section
12.5-842 of the Code of the City of Fort Worth, Texas (1986), as amended:
SERVICE MONTHLY RATE
Residential Curbside $11.50
Elective Car out $32.25
SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance
are in direct conflict with the provisions of such ordinances and such Code, in which event
conflicting provisions of such ordinances and such Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph
or section.

This ordinance shall be in full force and effect from and after October 1, 1998,
and it is so ordained

RECOMMENDATION
It is recommended that the City Council officially approve the following rate increase as provided for in
Section 12.5-842, of the City Code

DISCUSSION
On October 1, 1982, the Solid Waste Enterprise Fund was established and all solid waste management
operations began to be totally funded through service fees established for garbage collection and waste
disposal Prior to establishing solid waste management as an enterprise fund, funding for solid waste
management was derived from payment of fees by customers for garbage collection and a subsidy
from the General Fund Since the Solid Waste Enterprise Fund was created, fees have been
established and changed as follows.

The current fund balance of the Solid Waste Fund is insufficient to continue to finance Solid Waste
Management operations and meet anticipated environmental mandates In order to keep the Solid
Waste Enterprise Fund fiscally sound, it is necessary to increase the monthly residential garbage rate
by $ 0 50 The increase is included in the 1998-99 budget adopted by City Council The recommended
fee increase will provide sufficient revenue to finance solid waste management operations in FY 1998-
99 The City's garbage fee will still compare favorably to other major Texas cities after this proposed
adjustment.
