HomeMy WebLinkAboutOrdinance 13405~`~, l q Ordinance No:__~_~__j~C}~ AN ORDINANCE INCREASING THE ESTIMATED RECEII'TS AND APPROPRIATIONS IN THE GRANT FUND IN THE AMOUNT OF $7,632,000.00 FOR CDBG FUNDS, $2,458,000.00 FOR HOME FUNDS, $299,000 00 FOR ESG FUNDS AND $590,000.00 FOR HOPWA FUNDS SUBJECT TO THE RECEIPT OF THE GRANT FOR THE PURPOSE OF FUNDING THE 1998-1999 CITY OF FORT WORTH CONSOLIDATED ACTION PLAN, PROVIDING FORA SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1997-98 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grant Fund in the amount of $7,632,000.00 for CDBG Funds, $2,458,000.00 for HOME Funds, $299,000.00 for ESG Funds, and $590,000.00 for HOPWA Funds subject to the receipt of the grant for the purpose of funding the 1998-1999 City of Fort Worth Consolidated Action Plan. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void~for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13111 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. Staff recommends that after review of the proposed changes and consideration of citizen comments, that the City Council adopt the Consolidated Action Plan, which reflects the official allocation by the U.S. Department of Housing and Urban Development to the City of Fort QJorth of $11,069,000 for the four (4) grants: Community Development Block Grant ($7,632,000); Emergency Shelter Grant ($299,000); Housing Opportunities for Persons with AIDS ($590,000) and the HOME program ($2,348,000). Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grant Fund in an amount up to $7,632,000 for Community Development Block Grant funds, $2,548,000 for HOME funds, $299,000 for Emergency Shelter Grant Program funds and $590,000 for Housing Opportunities for Persons with AIDS funds, subject to receipt of the grant; and 3 Authorize the use of $270,725 from the Spanish Gates Apartments revenue account to the 1998 HOME Program account; and 4 Authorize the use of up to $875,000 in estimated program income from the interest earned and Revolving Loan Fund, and 5 Apply indirect cost rates as applicable for the grant fund in accordance with the City's ~i Administrative Regulation 3-15 DISCUSSION In 1994, HUD put forth a new policy regarding housing and community development activities carried out by local jurisdictions, which requires jurisdictions to submit a Consolidated Action Plan (CAP) The CAP is a document which combines application and planning processes for the four (4) major HUD funding sources. Community Development Block Grant (CDBG), HOME Investment Partnerships Program, Emergency Shelter Grant Program (ESG) and Housing Opportunities for Persons with AIDS (HOPWA) On April 17, 1995, the City of Fort Worth submitted its CAP to HUD which included a Citizen Participation Plan, Needs Analysis, Five-Year Strategic Plan, and an Action Plan detailing the first years funding use of activities. Working cooperatively with non-profit organizations, school districts, and the private sector, City staff was able to produce a Consolidated Plan which was both broad in scope and comprehensive with respect to the inclusion of activities and funding sources outside of the four (4) grants listed above. Each year, the City is required to submit a revised CAP Grant Application detailing the activities to be funded by the four (4) major funding sources. Total combined funding under the above-described programs for the program year ending May 31, 1999 is $11,069,000 This includes $7,632,000 in CDBG funds, $875,000 projected to be generated from Revolving Loan Funds (Program Income); $2,548,000 in HOME funds, $270,725 in matching funds for the HOME program, $299,000 in ESG funds, and $590,000 in HOPWA funds.
