HomeMy WebLinkAboutOrdinance 13307Ordinance No. ~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE NEW DEVELOPEMENT FUND IN THE AMOUNT OF $104,283 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN AGREEMENT WITH ONE COUNTRY CREEK LIMITED PARTNERSHIl' FOR INSTALLATION OF COMMUNITY FACILITIES -PARK CREEK ESTATES, PHASE A INCLUDING N BEACH STREET IIvIPROVEMENTS; PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1997-98 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the New Development Fund in the amount of $104,283.00 form available funds for the purpose of funding an agreement with One Country Creek Limited Partnership for installation of community facilities -Park Creek Estates, Phase A including N Beach Street Improvements. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13111 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. STREET IMPROVEMENTS RECOMMENDATION It is recommended that the City Council Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by $104,283 in the Special Assessments Fund from available funds, and 2. Authorize the transfer of $104,283 from the Special Assessments Fund to the New Development Fund, and 3 Adopt the attached appropriation ordinance increasing receipts and appropriations by $104,283 in the New Development Fund from available funds, and 4 Authorize the City Manager to execute a Community Facilities Agreement with the developer, One Country Creek Limited Partnership, for the installation of community facilities for Park Creek Estates, Phase A, including North Beach Street improvements. One Country Creek Limited Partnership, consisting of Master Development Corporation, General Partner, and Charles P Mady, limited partner, has executed a proposed contract for community facilities for a single fa .milt' _residential development (93 lots) located in northeast Fort Worth, east of Beach Street between Winterhazel and Basswood, in COUNCIL DISTRICT 4 The Community Facilities Agreement (CFA) was negotiated between the developer and the City to include a segment of North Beach Street south of this development abutting unplatted land owned by the developer With the completion of these improvements, North Beach Street will provide a continuous six lane divided roadway between Western Center and Basswood This Community Facilities Agreement is in compliance with standard City policy except as follows. (1) The developer's share of construction cost for North Beach Street is reduced to $150,000 This amount is approximately 38°Jo lower than the standard CFA requirements This reduction is recommended as an incentive to widen North Beach prior to development to alleviate traffic congestion in the area. (2) The developer will contribute $69,117 in cash upon final plat of the development. This amount includes a portion of the $150,000 construction cost ($45,717) as well as all engineering/administration costs ($3,400) and costs of an additional median opening requested by the developer ($20,000) City of J~ort Forth, Texas ~l~~yar And C~urt~~l ~,,~mr»un;c~t~an DATE REFERENCE NUMBER LOG NAME PAGE 1 /13/98 C-16542 20MADY 2 of 3 SUBJECT COMMUNITY FACILITIES AGREEMENT WITH ONE COUNTRY CREEK LIMITED PARTNERSHIP, FOR THE INSTALLATION OF COMMUNITY FACILITIES -PARK CREEK ESTATES, PHASE A, INCLUDING NORTH BEACH STREET IMPROVEMENTS (3) The remainder of the construction cost ($104,283) will be financed by the New Development Fund and secured through a mechanic's lien The developer will reimburse the Assessment Revolving Fund in three annual installments of $34,761 commencing prior to the first anniversary of the initial payment in (2) above (4) Approximately 2,615 linear feet of sidewalk will be installed as development occurs rather than with the construction of North Beach Street.
