HomeMy WebLinkAboutOrdinance 13407Ordinance No. 0 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND, LEOSE, IN THE AMOUNT OF $105,224 19 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING CONTINUED TRAINING OF FULL TIME LAW ENFORCEMENT SUPPORT PERSONNEL, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1997-98 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund, LEOSE, in the amount of $105,224 19 from available funds for the purpose of funding continued training of full time law enforcement support personnel. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13111 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in duect conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by $105,224 19 from available funds in the Special Trust Fund, LEOSE. DISCUSSION Section 415 0845 of the Texas Government Code directs the Comptroller of Public Accounts to make an annual allocation from the LEOSE account to qualified law enforcement agencies for expenses related to the continuing education of persons licensed under Chapter 415, Govemment Code. Of the account, 20 percent is allocated equally among the qualified agencies. The remaining 80 percent is allocated on the basis of the number of eligible law enforcement positions each agency had as of January 1 of the preceding calendar year All funds received must be used to ensure the continuing education of persons licensed under Chapter 415, Government Code or to provide necessary training, as determined by the agency head, to full- time, fully paid law enforcement support personnel in the agency LEOSE funding now constitutes the majority of funds available to the Police Department for continuing education FISCAL INFORMATION/CERTIFICATION The Director of Fiscal Services certifies that upon adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Special Trust Fund, LEOSE Project.
