ORDINANCE NO. J~3d~
AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING
ORDINANCE, ORDINANCE NO 3011, AS AMENDED, SAME BEING AN
ORDINANCE REGULATING AND RESTRICTING THE LOCATION AND USE
OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY,
RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES
AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF
YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND
LOADING, AND THE DENSITY OF POPULATION, AND FOR SUCH
PURPOSES DIVIDING THE MUNICIPALITY INTO DISTRICTS OF SUCH
NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO
CARRY OUT THESE REGULATIONS AND SHOWING SUCH DISTRICTS
AND THE BOUNDARIES THEREOF UPON "DISTRICT MAPS", PROVIDING
FOR INTERPRETATION, PURPOSE AND CONFLICT, PROVIDING THAT
THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES,
PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE,
PROVIDING A PENALTY CLAUSE, PROVIDING FOR PUBLICATION AND
NAMING AN EFFECTIVE DATE
SECTION 1.
That Ordinance No 3011, as amended, be and is hereby amended so that the permitted uses in the
hereinafter described areas be altered, changed, and amended as follows
Z-97-136 Block 134, Lots 7-10, North Fort Worth Addition
From "E" Commercial to "PD/SU" Planned Development/Specific Use for used car
sales on ground level, a make ready shop to include minor auto repair, and one
residence (residence at 1205 Terrace Avenue exists and may be retained until
demolished) No commercial vehicular or pedestrian access to Terrace Avenue Any
new construction may not exceed 2 stories or 30' in height and all exterior lighting to
be directed away from residential property Site plan required.

Z-97-146 BEING A 23 189 acre tract of land situated in the John F Heath Survey, Abstract
No 641, Tarrant County, Texas and being a portion of a tract of land conveyed to
Jerry L Thomas and recorded in Volume 7832, Page 1753, Deed Records, Tarrant
County, Texas said 23 189 acre tract of land being more particularly described by
metes and bound as follows

COMMENCING at the intersection of the southwesterly right-of--way hne of Bellaire
Drive South (a variable width public right-of--way) and the northwesterly right-of--way
line of Bryant Irvin Road (a 120' wide public right-of--way), said point being the
beginning of a curve to the left whose radius is 1,280 00 feet and long chord bears
S44°30'54"W, 199 86 feet,
THENCE along said northwesterly right-of--way line and along said curve m a
southwesterly direction, through a central angle of 08 ° 57' 19", an arc length of 200 06
feet to a 5/8" iron pm found at the southeast corner of tract of land conveyed to
Hawthorne Park Joint Venture and being the southwest corner of Bryant Irvin Road
as presently dedicated and being the POINT OF BEGINNING of the herein described
tract, said point being in said curve to the left whose radius is 1,280 00 feet and long
chord .bears S3 5 ° 01'07"W, 223 94 feet,
THENCE along the proposed northwesterly right-of--way line of said Bryant Irvin
Road and along said curve, through a central angle of 10°02'30", an arc length of
224 33 feet to a 5/8" iron pin set ,
THENCE S30°00'00"W, continuing along said proposed right-of--way line a distance
of 650 70 feet to a 5/8" iron pm set,
THENCE N60°01'22"W, a distance of 239 90 feet to a 5/8" iron pm set;
THENCE S35°22'33"W, a distance of 606 26 feet to a 5/8" iron pm set,
THENCE N60°00'00"W, a distance of 156 45 feet to a 5/8" iron pm set,
THENCE N65 ° 54' 15 "W, a distance of 229 50 feet to a 5/8 "iron pin set,
THENCE N73 °05'46"W, a distance of 181 86 feet to a 5/8" iron pm set m the east
hne of Mira Vista Addition, an addition to the Crty of Fort Worth according to the
plat recorded in Cabinet A, Slide No 423 and 424, said plat records,
THENCE N16 ° 54'21 "E, along the east hne of said Mira Vista Addition, a distance
of 944 28 feet to a 1" iron pm m concrete found at the southwest corner of Lot 9,

SECTION 2.
That the zoning regulations and districts, as herein established, have been made m accordance wrth
the comprehensive plan for the purpose of promoting the health, safety, morals and general welfare
of the community They have been designed to lessen congestion nn the streets, to secure safety from
fire, panic, flood and other dangers, to provide adequate inght and anr; to prevent overcrowding of
land, to avond undue concentratnon of populatnon, to facilntate the adequate provnsnons of
transportatnon, water, sewerage, parks and other pubinc requnrements They have been made after
full and complete pubinc hean-mg wrth reasonable consnderatnon, among other things, of the character
of the dnstrnct and rts peculiar suntabilrty for the particular uses and wrth a view of consenvmg the
value of a bunldnng and encouraging the most appropriate use of land throughout the community
SECTION 3
That thns ordinance shall be cumulatnve of all other ordinances of the Crty of Fort Worth affecting
zoning and shall not repeal any of the provnsnons of such ordinances, except nn those instances where
provnsnons of such ordinances are m dnrect conflnct wrth the provnsnons of thns ordinance
SECTION 4.
That all rnghts or remednes of the Cnty of Fort Worth, Texas, are expressly saved as to any and all
vnolatnons of Ordnnance No 3011 or of any amendments thereto that have accrued at the tame of the
effectnve date of tlis ordinance, and as to such accrued vnolatnons, and all pending lntngatnon, both cavil
or cnmmal, same shall not be affected by thns ordinance but maybe prosecuted until final dnsposrtnon
by the courts.
SECTION 5.
It ns hereby declared to be the nntentnon of the Cnty Council that the sectnons, paragraphs, sentences,
clauses and phrases of thns ordnnance are severable, and of any phrase, clause, sentence, paragraph or
sectnon of thns ordinance shall be declared vond, meffectnve or unconstrtutnonal by the valid judgment
or decree of any court of competent ~urnsdnctnon, such vondness, meffectnveness or unconstrtutnonalrty
shall not affect any of the remannnng phrases, clauses, sentences, paragraphs or sectnons of thns
ordnnance, snnce the same would have been enacted by the Cnty Council wnthout the nncorporatnon
herenn of any such vond, meffectnve or unconstntutnonal phrase, clause, sentence, paragraph or sectnon.
SECTION 6.
That any person, firm or corporatnon who vnolates, dnsobeys, omnts, neglects or refuses to comply
wrth or who resnsts the enforcement of any of the provnsnons of thus ordinance shall be fined not more
than Two Thousand Dollars ($2000 00) for each offense Each day that a vnolatnon ns permntted to
exnst shall constntute a separate offense

SECTION 7
That the City Secretary of the City of Fort Worth, Texas is hereby directed to ~pubh`sh-this ~ordmance
for two (2) days m the official newspaper of the Crty of Fort Worth, Texas, as authorized by
' V T C.A. Local Government Code Subsection 52 013
SECTION 8.
That this ordinance shall be m full force and effect from and after the date of rts passage and
publication as required by law, and it is so ordained.
