~~~ Ordinance No.~ 3 -5(~ AN ORDINANCE INCREASING THE ESTIMATED RECEII'TS AND APPROPRIATIONS IN THE GRANT FUND IN THE AMOUNT OF $356,263 00 SUBJECT TO THE RECEIPT OF THE FUNDS FROM THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS FOR THE PURPOSE OF FUNDING VARIOUS ENVIRONMENTAL PROJECTS, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1998-99 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations the Grant Fund in the amount of $356,263 00 subject to the receipt of the funds from the North Central Texas Council of Governments for the purpose of funding various environmental projects. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or '`~^"' parts of se~fiuns o'i u:IS'~iuiiiiance; ~iiicn'saia remaumg provisions shall be and remain m full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13111 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations up to $356,263 00 in the Grant Fund, subject to the receipt of the funds, and 3 Authorize the use of up to $330,000 00 during Fiscal Year `98-99, from the Environmental Management Fund in matching funds for the contract listed in recommendation 1(b) September 1998 is the scheduled award date for these grants. The funding period is from October 1998 through September 1999 DISCUSSION The Waste Paint Recycling Project will provide funds to hire a consultant to locate paint recycling companies, to research cost effective and innovative methods for use and distribution of recycled paint, and to develop standardized recycled paint specifications for the paint being collected Currently, all paint received at the City's Environmental Collection Center (ECC) 6s being sent for disposal The cost to dispose of a gallon of paint is currently lower than the City's cost in prior years to recycle a gallon of paint. In the past, recycled ,paint was given to the City's Graffiti Abatement Program, which now has a large stockpile of paint and does not need more.. The reduction of the shared costs should attract more participation by other municipalities, thereby lowering the per household cost. FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that upon approval of the above recommendations, adoption of the attached appropriation ordinance, and receipt of the grants, funds will be available in the current operating budget, as appropriated, of the Grant Fund.
