HomeMy WebLinkAboutOrdinance 18471-02-2009Ordinance No. 18471-02-2009 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF 553,000.00, FOR THE PURPOSE OF AUTHORIZING THE ACQUISITION OF TWO PERMANENT SEWER FACILITY EASEMENT AND WATER -RECLAMATION MAIN EASEMENTS FROM JAMES D. AND SUZANNE S. GABERINO LTD.: PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH. TEXAS: SECTION 1 That in addition tc those amounts allocated to the various City departments for Fiscal Year 200$-2009, there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $53,000.00, for the purpose of authorizing the acquisition of two permanent sewer facility easement and water -reclamation main easements from James D. and Suzanne S. Gaberino Ltd. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18283 and aII other ordinances and appropriations amending the same except in those instances where the provisions ofi this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of $53,000.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $53,000.00; 3. Authorize the acquisition of two Permanent Sewer Facility Easements and Water-Reclamation {Re-use} Main Easements from James D. and Suzanne S. Gaberino, Ltd., at 8401 Lowery Road located in east Fort Worth, for the construction of Sewer and Water-Reclamation {Re-Use} Improvements; 4. Find that the price offered in the amount of $20,295.00 plus an estimated closing cost of $2,000.00 is just compensation; and 5. Authorize the acceptance and recording of appropriate instruments.
