HomeMy WebLinkAboutOrdinance 13617Ordinance No.~~~ AN ORDINANCE INCREASING THE ESTIMATED RECEII'TS AND APPROPRIATIONS IN THE SPECIAL ASSESSMENTS FUND IN THE AMOUNT OF $621,612.00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE FORT WORTH PUBLIC IMPROVEMENT DISTRICT NO 1, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated'to the various City departments for the Fiscal Year 1998-99 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Assessments Fund in the amount of $621,612.00 from available funds for the purpose of fiznding the Fort Worth Public Improvement District No. 1 SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13540 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. DISCUSSION Oin September 15, 1998, the City Council adopted M&C G-12321, which directed that certain improvements and/or services ("improvements") shall be provided in Fort Worth Public Improvement District No 1 during the 1998-99 fiscal year It also adopted the proposed assessment roll and provided notice of this benefit hearing The improvements to be provided and the costs thereof are Total Cost To Be Assessed Maintenance and Landscaping Program $ 548,924 $329,608 Promotions Program 72,950 43,804 Marketing Program 67,500 40,530 SE:curity Program 23,165 13,910 Transportation and Parking Program 109,740 65,895 City Administration Fee 5,000 5,000 Management Program 207,945 122.865 TCJTAL $1,035,224 $621,612 The $413,612 difference between total costs and assessments includes $231,512 in direct payments from the City, $75,100 in revenues from district activities, and $107,000 from other miscellaneous revenue sources, including the use of district reserve funds, if necessary City of Fort Worth, Texas M'Ayor And Caunc~l CammunicAtian DATE= REFERENCE NUMBER LOG NAME PAGE 10/20/98 BH-190 13PID1 2 of 2 SUBJECT BENEFIT HEARING AND LEVYING OF ASSESSMENTS FOR FISCAL YEAR 1998-99 ~_ FOR FORT WORTH PUBLIC IMPROVEMENT DISTRICT NO 1 AND ADOPTION OF RELATED APPROPRIATION ORDINANCE All costs of improvements shall be assessed against private property located in the district and the owners of the property The City Manager has filed with the City Secretary a proposed assessment roll and an estimate of the assessments against each parcel Based on the appraised value of the property, and considering the benefits to be received from the proposed improvements, it is the opinion of the City staff that each parcel of property will be enhanced in value by an amount equal to or more than the proposed assessments upon completion of the improvements and provisions of services in accordance with the PID1 management contract.
