HomeMy WebLinkAboutOrdinance 13323ORDINANCE NO ,~3 AN ORDINANCE FINDING THAT THE HOLDING OF THE GENERAL OBLIGATION BOND ELECTION ON FEBRUARY 7, 1998, RATHER THAN ON A UNIFORM ELECTION DATE, IS IN THE PUBLIC INTEREST WHEREAS, on November 11, 1997, the Fort Worth City Council adopted Ordinance No 13225, calling for an election to be held on February 7, 1998, on the question of the issuance of general obligation bonds for the purpose of constructing capital improvements within the City; and WHEREAS, the date for the scheduled election, being February 7, 1998, is a date other than a uniform election date prescribed by Section 41 001 of Texas Election Code, and WHEREAS, Section 41 001(b)(3) of the Texas Election Code provides that the requirement that elections be held on uniform election dates does not apply to an election on the issuance or assumption of bonds, if the governing body of the political subdivision issuing or assuming the bonds, by resolution, order or ordinance, finds that holding the election on a date other than a uniform election date is in the public interest, which finding is conclusive and incontestable, and WHEREAS, it is the finding of the Fort Worth City Council that the holding of said scheduled election on February 7, 1998, is in the public interest; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS 1 That the City Council hereby finds that the election to be held on February 7, 1998, as called for and ordered by Ordinance No 13225, is an election for the issuance of bonds, that the date of the scheduled election, being February 7,1998, is a date other than a uniform election date prescribed by Section 41 001 of the Texas Election Code, and that the holding of said election on February 7, 1998, rather than on a uniform election date, is in the public interest. 2 That is hereby officially found and determined that the meeting at which this ordinance was adopted was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551 of the Texas Government Code 3 That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained PASSED AND ADOPTED this, the 27th day of January, 1998, at a regular public meeting of the City Council of the City of Fort Worth Kenneth Barr, Mayor of the City of Fort Worth ~~ `' n . x~r ,~,, ATTEST ~-~~„~ ~ ~~: s %~~~+ q 5 w ~~ • Y R ~ ~ ~' +~ A icezChurch -' k ~G~i~tyrSecretary;of the City~'of Fort Worth, Texas +,~,,,, ;~~ APPROVED: AS TO FORM AND LEGALITY William W Wood Deputy City Attorney of the City of Fort Worth, Texas Date ~ Adopted _ ~ y9~ Effective ~ 99~
