HomeMy WebLinkAboutOrdinance 13532ORDINANCE NO . ,~ 7J. ~ JoL AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS IN THE POLICE DEPARTMENT; CREATING TWO ADDITIONAL CORPORAL/DETECTIVE POSITIONS PROVIDING A STATEMENT OF PURPOSE AND INTENT FOR THE ADOPTION OF THIS ORDINANCE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN WHEREAS, the Police Chief has requested the City Council to readjust and thereafter specify the total number of authorized civil service positions in the Police Department for the remainder of the 1997-1998 Fiscal Year; and WHEREAS, the City's most recent ordinance concerning the authorized and budgeted positions for the Police Department adjusted the Department's civil service staffing as follows Deputy Chiefs 5 Captains 12 Lieutenants 46 Sergeants 122 Corporal/Detectives 184 Police Officers 824 TOTAL 1,193 WHEREAS, the Police Chief now requests the Council to adjust the authorized number of Police Department civil service positions into conformity with the proposed changes as set forth immediately below in order to effect efficient economy of the operations of the Police Department; and WHEREAS, pursuant to Chapter 143 021(x), Texas Local Government Code, the City Council may prescribe and/or adjust the authorized number of positions in each classification (rank) by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That, effective immediately upon the formal adoption of this ordinance, the following positions shall be the only civil service positions authorized in the City of Fort Worth Police Department for the remainder of the fiscal year 1997-1998 or until modified by subsequent ordinance Deputy Chiefs 5 Captains 12 Lieutenants 46 Sergeants 122 Corporal/Detectives 186 Police Officers 824 TOTAL 1,195 * Creates two new positions SECTION 2 The "Mayor and Council Communication" memorandum which is presented contemporaneously with this ordinance is hereby ex- pressly incorporated herein by reference for further clarification and explanation of the purposes and intent of the Council in their adoption of this ordinance In addition, it is expressly stated that this ordinance serves only to increase the total number of corporal/detective positions SECTION 3 This ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior 2 civil service staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinan- ces and such Code provisions are hereby repealed SECTION 4 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconsti- tutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section SECTION 5 This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained APPROVED AS TO FORM AND LEGALITY it Attorney Date: ~~~m~9S ADOPTED `I - ~ ~-rl S' EFFECTIVE ~~- ~Z~-~~ 3 City of Fort Worth, Texas ~1-~Ayar And ~aunc~l Cammun~cAt~an DATE REFERENCE NUMBER LOG:'NAME PAGE 7/28/98 **G-12282 35CIVIL 1 of 2 SuB~ECT ORDINANCE AUTHORIZING CIVIL SERVICE STAFFING FOR THE POLICE DEPARTMENT RECOMMENDATION It is recommended that the City Council adopt the attached ordinance specifying the authorized positions in the Police Department, increasing by two (2) the number of authorized corporal/detective positions. The proposed increase in the Police Department's authorized strength is due to the award of a state grant that funds two corporalldetective positions for domestic assault response. On February 10, 1998 (M&C G-12132), the City Council authorized the City Manager to apply for and accept, if awarded, five grants from the Governor's Office, Criminal Justice Division On June 1, 1998, the City Manager was formally notified by the Governor's Office, Criminal Justice Division that two of the five grants applied for, one for the Domestic Assault Response Team and one for the Enhanced Domestic Assault Response Team, have been awarded to the City of Fort Worth.. The Domestic Assault Response Team grant, which takes effect on October 1, 1998, continues two civilian positions that are currently funded by another State grant that will expire in September, 1998 The Enhanced :Domestic Assault Response Team grant funds two corporal/detective position for domestic assault response. Riding with a trained crisis intervention volunteer, each detective will respond to domestic violence calls in the North and East Field Operations Divisions, 32 hours per week. Enhanced Domestic Assault Response Team activities will include crisis intervention, information and referral, facilitate admission to emergency shelter when indicated, conduct comprehensive evidence gathering and investigation, and relieve beat patrol units from the scene in a timely manner when the law enforcement process is complete. The teams will also patrol prior offense residences and protective order addresses to monitor the level of victim safety During the remaining 8 hours of the work week, the detectives will file all paperwork concerning the domestic violence calls, update information on the domestic violence risk file, and enter cases into the case file system The Enhanced Domestic Assault Response Team grant totals $124,844, with $78,720 from the Governor's Office; $30,316 for the City's cash match (funded from Awarded Assets), and $15,808 for the City's in-kind contribution {volunteer hours) The grant period is from June 1, 1998 to May 31, 1999 City of Fort Worth, Texas A ar And Caunc~l C,ammun~cAt~an ~~ y DATE 7/28/98 REFERENCE NUMBER **G-12282 LOG NAME 35CIVIL PAGE 2 of 2 SUBJECT ORDINANCE AUTHORIZING CIVIL SERVICE STAFFING FOR THE POLICE DEPARTMENT The Police Department's authorized strength is currently 1,193 civil service positions.
