AN ORDINANCE DISANNEXING AND DISCONTINUING FROM THE
CORPORATE LIMITS OF THE CITY OF FORT WORTH A CERTAIN
2.693 ACRE TRACT OF LAND SITUATED IN THE WILLIAM EVANS
SURVEY, ABSTRACT N0.467, IN THE CITY OF FORT WORTH, TEXAS,
AND BEING A PORTION OF THAT TRACT OF LAND DESCRIBED IN A
DEED RECORDED IN VOLUME 12451, PAGE 1824 OF THE DEED
RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING THAT THIS
ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN
CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL
BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT
CONFLICT; PROVIDING FOR SEVERABILITY; AND NAMING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That, in accordance with and subject to that certain Joint Resolution and
Agreement between the City of Fort Worth and the City of Watauga, a copy of which is
attached hereto as Exhibit "A" and expressly made a part hereof, the following described
land and territory within the corporate limits of the City of Fort Worth is hereby disannexed
and ordered discontinued as a part of the City of Fort Worth, Texas, said territory being
described as follows.
2 693 acres situated in the WILLIAM EVANS SURVEY, Abstract. No 467, City of Fort
Worth and Unincorporated Tarrant County, Texas, being a portion of that certain tract of
land conveyed to Havener Rupert Limited Partnership, by deed recorded in Volume
12451, Page 1824, Deed Records, Tarrant County, Texas, said 2.693 acres being more
particularly described, as follows:
Starting AT A 1/2" iron set for the southeast corner of PHASE IV, SECTION 1, PARK
GLEN ADDITION, an Addition to the City of Fort Worth, Tarrant County, Texas, recorded
in Plat Cabinet A, Slide 376, Plat Records, Tarrant County, Texas, Commence South 00
Degrees 52 minutes 25 seconds East, 299 74 feet for a point of BEGINNING,
THENCE South 00 degrees 52 minutes 25 seconds East, 50 00 feet to a 1!2" iron set in
the called south line of said EVANS SURVEY and the called north line of the DAVlD L.
HALL SURVEY, Abstract. No 700, City of Watauga, Tarrant County, Texas,
THENCE South 88 degrees 53 minutes 47 seconds West, along the common line of said
EVANS and HALL SURVEYS, 2346 16 feet to a 1/2" iron set in the west line of said
Havener Rupert Limited Partnership tract and the east line of that certain tract of land
conveyed to WPC -Basswood Development Corporation, by deed recorded in Volume
12172, Page 796, Deed Records, Tarrant County, Texas;
THENCE North 00 degrees 52 minutes 25 seconds West, along the common line of said
Havener Rupert Limited Partnership and WPC -Basswood Development Corporation
tracts, 50 00 feet;
THENCE North 88 degrees 53 minutes 47 seconds East, 234616 feet to the POINT OF
BEGINNING and containing 2 693 acres of land
SECTION 2.
That this ordinance shall and does amend every prior ordinance in conflict
herewith, but as to all other ordinances or sections of ordinances not in direct conflict, this
ordinance shall be, and the same is hereby made cumulative.
SECTION 3.
That it is hereby declared to be the intent of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by
the City Council without the incorporation in this ordinance of any unconstitutional phrase,
clause, sentence, paragraph or section.
SECTION 4.
That this ordinance shall be in full force and effect from and after the date of its
passage by the City Council, and it is so ordained

THE WILLIAM EVANS SURVEY, ABSTRACT NO 467 PURSUANT TO A JOINT
RESOLUTION AND AGREEMENT WITH THE CITY OF WATAUGA
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance
DISCUSSION
On June 23, 1998, the City Council authorized City Secretary Contract No 24064, (M&C C-16848), a
Joint Resolution and Agreement with the City of Watauga in order to facilitate the proposed residential
development of an 80 5 acre tract of land located west of Highway 377, north of Western Center
Boulevard, and south of Basswood Boulevard, and commonly referred to as the Park Vista
development. This property is currently owned by Havener Rupert Limited Partnership and the
proposed developer is Gehan Homes. The Joint Resolution and Agreement provides for the
disannexation of the 2.693 acre portion of this property, which is located within the Fort Worth city
limits. Upon its disannexation by Fort Worth, the City of Watauga will initiate proceedings to annex the
property into its city limits.
Section 8 of the attached Joint Resolution and Agreement provides that in consideration of the City of
Fort Worth disannexing and relinquishing extra territorial jurisdiction (ETJ) rights to the property, the
City of Watauga will create a Public Improvement District (PID) within 180 days of disannexation In the
event that the described improvements and services are not completed and provided within 2 years
following disannexation, or are not continuously provided for in a period of 5 years from the date of
completion of the improvements, Watauga is obligated to take all actions necessary to disannex and
release ETJ rights to the property The services to be provided within the Watauga PID are described
in Exhibit D to the Joint Resolution and Agreement, and are similar to those provided in Fort Worth's
Public Improvement District No 4, which serves the nearby Park Glen neighborhood

The Finance Director certifies that adoption of the attached ordinance will have no material affect on
City funds.
