AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN OF THE
CITY OF FORT WORTH FOR THE CRESTLINE, WEST BYERS AND
NORTH HI-MOUNT NEIGHBORHOODS, PROVIDING THAT THE
ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Crestline, West Byers and North Hi-Mount neighborhoods west
of the Central Business District (collectively referred to as the "Westside
Neighborhoods") are predominantly single-family neighborhoods,
WHEREAS, the comprehensive plan for the Westside Neighborhoods, consisting
of the Arlington Heights 1984 Sector Plan, recommends two-family development in
certain sections where the predominant use is single-family;
WHEREAS, portions of the Westside Neighborhoods that are developed with
single-family homes are zoned "B' Two-Family, which would allow the construction of
two-family residences, or "C-R", "C" or "D" Multi-Family, which would allow multi-family
development;
WHEREAS, a 180-day moratorium on zoning and construction of two-family and
multi-family dwellings in the Westside Neighborhoods and four other neighborhoods
west of the Central Business District was enacted on June 16, 1998, in order to allow
the Planning and Growth Management Department and the Development Department
to evaluate the relationship between current land uses, zoning, and the comprehensive
plan, and
WHEREAS, it is advisable to amend the Arlington Heights 1984 Sector Plan for
the Westside Neighborhoods to reflect prevailing land uses in the neighborhoods, in
order to maintain the character and integrity of the area and to promote sound
development and the public health, safety, and welfare,
WHEREAS, the proposed amendments have been reviewed by the Plan
Commission and the Department of Planning and Growth Management;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS, AS FOLLOWS:
SECTION 1.
The Arlington Heights 1984 Sector Plan for the Crestline, West Byers and North
Hi-Mount neighborhoods is amended by substituting the maps showing proposed land
uses that are attached as Exhibits "A", "B" and "C" for the current maps of the Crestline,
West Byers and North Hi-Mount areas.
SECTION:2.
This ordinance shall be cumulative of all provisions of ordinances and of the
Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions
of this ordinance are in direct conflict with the provisions of such ordinances and
suchCode, in which event such conflicting provisions of such ordinances and Code are
hereby suspended for the period during which this ordinance is in effect.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if
any phrase, clause, sentence, paragraph or section of this ordinance shall be declared
void, ineffective or unconstitutional by the valid judgment or final decree of a court of
competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not

affect any of the remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City Council without the
incorporation herein of any such void, ineffective or unconstitutional phrase, clause,
sentence, paragraph or section
SECTION 4.
This ordinance shall be in full force and effect from and after its passage

PROPERTIES IN THE WEST BYERS, CRESTLINE, AND NORTH HI-MOUNT
NEIGHBORHOODS
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance amending the City's Comprehensive
Plan for certain properties in the West Byers, Crestline and North Hi-Mount neighborhoods from Two-
Family to Single-Family, and from Multi-Family to Single-Family and Two-Family, so as to reflect prevailing
land uses in said neighborhoods.
DISCUSSION
On June 16, 1998, the City Council established a moratorium on construction or expansion of two-family
and multi-family dwellings, and on rezoning to two-family or multi-family districts in seven designated
neighborhoods on the City's west side. An analysis of residential zoning and development issues was
conducted, as well as identification of measures to address the issues.
The Comprehensive Pian for the area (Arlington Heights Sector Plan, 1984) was reviewed. Current
analysis suggests that some areas, which were designated to be two-family in the past, -should now be
designated as single-family Neighborhood leaders developed a rezoning plan with staff support. The
proposed zoning changes were then shared with property owners and revised as appropriate.
Before rezoning can be considered, the Comprehensive Plan needs to be amended to reflect the
prevailing land uses. The proposed plan amendments are shown on Exhibits "A", "B" and "C"
Exhibit "A" is the WEST BYERS neighborhood. The proposed amendments to the Plan are as follows:

Tract 3 from Commercial to Single-Family
Tracts 4,5,6 from Single-Family to Two-Family

The Plan Commission considered these proposed plan amendments at its October 28th public hearing,
where no one spoke in opposition The Plan Commission voted to recommend the amendments, but
noted some concerns, which are addressed in the attached letter
The City Plan Commission .recommendation for amending the plan is being forwarded to the City Council
for a November 10, 1998, hearing. Approval at that time would permit a Zoning Commission public
hearing, and action on November 11, 1998. A Zoning Commission recommendation could be forwarded
to the City Council for hearing and action on December 8, 1998, prior to the expiration of the moratorium
on December 12, 1998
