HomeMy WebLinkAboutOrdinance 13646ORDINANCE NO. ~~ ~ ~~ AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A TEN FOOT TO 20 FOOT WIDE, AND 405 FOOT LONG SANITARY SEWER EASEMENT, PARK GLEN ADDITION, PHASE XI, SECTION 2, TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. THAT the sanitary sewer easement vacating a 10 foot to 20 foot variable width, containing 7,397 square feet, traversing Lots 59 thru 63, Block 104, in the proposed Park Glen Addition, Phase XI, Section 2, Nancy Ann Robert Survey, as recorded in Abstract No 1275, Volume 8282, Page 28 and Volume 10171, Page 1723, Plat Records of Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished SECTION 2. That the fee to the land in the above described vacated sanitary sewer easement are hereby released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. DISCUSSION Carter & Burgess, Inc., 3880 Hulen Street, has requested vacation of the above-referenced sanitary sewer easement to create more single family building lots The easement was acquired by dedication, and no surface or subsurtace improvements or utilities currently exist. A newly relocated replacement easement is proposed on the recently submitted plat. Reviewing City departments and public utility companies have raised no objection to this vacation This request is located in COUNCIL DISTRICT 4 FISCAL 1NFORMATIONlCERTIFICATION The Land Agent for the City of Fort Worth has determined that a fee of $1 00 has been received and therefore satisfies the City's interests.
