HomeMy WebLinkAboutOrdinance 13554Ordinance No S AN ORDINANCE INCREASING THE ESTIMATED RECEII'TS AND APPROPRIATIONS IN THE GRANT FUND IN THE AMOUNT OF $98,540 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE ENVIRONMENTAL MANAGEMENT'S AIR POLLUTION CONTROL PROGRAM THROUGH A GRANT FROM THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION I That in addition to those amounts allocated to the various City departments for the Fiscal Year 1998-99 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grant Fund in the amount of $98,540.00 from available funds for the purpose of funding the Environmental Management's Air Pollution Control Program through a grant from the Texas Natural Resource Conservation Commission. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way imparr the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13111 and all other ordinances and appropnations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. Authorize anon-interest bearing inter-fund loan from the Environmental Management Fund to the Grant Fund in the amount of $24,635 for interim financing of 25% of this grant project pending contract execution, and 3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grant Fund by $98,540 from available funds, and 4 Waive the collection of indirect costs for this grant in the amount of $9,614, based on the most current indirect cost rate of 21 33% for this department, and use the amount of waived indirect costs as a portion of the City's required in-kind matching amount for this project; and 5 Authorize the use of $65,693 in the General Fund as an in-kind match for this grant. DISCUSSION The TNRCC is the pass-through agency for all Environmental Protection Agency (EPA) Section 105 grant funds. EPA Section 105 grant funds received annually by the City's Air Pollution Control Program, in cooperation with the Texas Natural Resource Conservation Commission, enforce the Federal and State Clean Air act provision within the City of Fort Worth This includes inspections of specific emission sources, daily monitoring of ozone and particulate levels, permit reviews, and complaint investigations. This grant requires alocal-in-kind match of $65,693 Funds in the amount of $56,079 which are included in the City's proposed budget for Fiscal Year 1998-99 will be used as matching funds for this grant. The remaining $9,614 of uncollected indirect costs will be considered part of the City's matching portion as a non-cash in-kind amount. The interim funding of $24,635 will be returned to the Environmental Management Fund upon execution of a grant contract with the TNRCC No City funds will be expended before the grant is approved Upon approval and acceptance of the grant, City funds will be expended before receipt of grant funds.
