HomeMy WebLinkAboutOrdinance 13455 Ordinance No , .~~7 AN ORDINANCE INCREASING THE ESTIMATED RECEII'TS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $528,412.00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING TRACK FAILURE REPAIR AT DOROTHY SPUR, MILE POST 629; PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATNE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1997-98 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $528,412,00 from available funds for the purpose of funding track failure repair at Dorothy Spur, Mile Post 629 SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way nnpair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulaflve of Ordinance No. 13111 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, inwhich instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund by $528,412.00 from available funds. Over the years, various attempts have been made to correct the problem at MP 629 on the RAILTRAN line that is caused by poor drainage. In 1994, the 60" corrugated metal pipe, which had been installed by the Union Pacific Railroad, pulled apart. Burlington placed corrugated bands around the pipe in an attempt to hold it together In May, 1995, after several heavy rains, the track began to shift, necessitating a 10 mph slow order for that section of track. French drains were installed in an effort to drain the water inside the embankment. A culvert inspection revealed that the metal pipe was continuing to shift and that without immediate action the entire line would fail, possibly causing a derailment. Burlington solicited bids for the portion of the work which would not be performed by their own forces, primarily dirt movement. Gilbert Construction was selected as the successful bidder Gilbert Construction provided all dirt work, labor, and equipment while Burlington provided track work labor and all materials, totaling $400,000 Work began on September 10, 1995, at which time the line was taken out of service. When the excavation of the embankment began, water was discovered deeper than originally estimated necessitating additional excavation in an effort to remove all the standing water Once the concrete box culvert was set, additional french drains were installed in an attempt to drain the rest of the embankment. Also, additional work was needed to locate an old drainage pipe which, it was suspected, was leaking and causing additional track failure. The pipe was located and eventually removed These unexpected changes increased the original estimated cost from $400,000 to $528,412. Sufficient funds are available in the RAILTRAN account for this expenditure.
