HomeMy WebLinkAboutOrdinance 13661• ~- :- ORDINANCE NO. _ 1 ~ (~ ~ 9 AN ORDINANCE AMENDING THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY THE AMENDMENT OF CHAPTER 12.5, "ENVIRONMENTAL PROTECTION AND COMPLIANCE" ARTICLE VII "LIQUID WASTE", BY ADDING SECTION 12.5-703 "DISPOSAL FEE" AND BY AMENDING SUBSECTION (D) OF SECTION 12.5-707, "ISSUANCE AND DISPLAY OF PERMIT"; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE: SECTION 1. That Chapter 12.5, "Environmental Protection and Compliance", Article VII., "Liquid Waste", of the Code of the City of Fort Worth (1986), as amended, is hereby further amended by the adding of section 12.5-703 "Disposal Fee" which shall be and read as follows. "12.5-703 Disposal Fee City Council shall set fees for the disposal of liquid waste." SECTION 2 Subsection (d) of section 12.5-707, "Issuance and Display of Pernut," of the Code of the City of Fort Worth (1986), as amended, is amended to be and read as follows. "(d) The city council shall set a permit fee for each registered vehicle." SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. ! ~' ~. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent ~unsdiction, such unconstitutionality shall not affect any of the remauung phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall be in full force and effect after its passage as required by law, and it is so ordained. Approve the fee schedule as shown below DISCUSSION In October 1987, the City Council established regulations and fees associated with the transportation and disposal of liquid waste. This regulation is currently a part of the Environmental Protection and Compliance section of the City Code The Fort Worth Water Department staff conducted cost of service studies to establish proposed fiscal year 1999 water and wastewater rates. As part of the studies, Biochemical Oxygen Demand (BOD) and Total Suspended Solids (TSS) rates were proposed These rates were adopted by the City Council on September 15, 1998 (M&C G-12326) Based on the new rates, the Water Department staff proposes the following fees for the permitting of liquid waste haulers and the disposal of liquid waste Charges Disposal Rates Plus $40/load Monthly Service Charge Trip Ticket Books Permitting Fee Current $8.29/1000 gallons -0- $3 00 $240/year -first vehicle $170/year -each additional vehicle Proposed $16 09/1000 gallons $4 50 $10 00 $300 Per Vehicle The Pollution Control Division of the Water Department is responsible for administration of the Liquid Waste Hauler Program The attached ordinance reflects the changes in the liquid waste haulers permitting fees, and includes a section for liquid waste disposal fees.
