AN ORDINANCE REPEALING A MORATORIUM ON ACCEPTANCE OF
APPLICATIONS FOR ZONING OR DEVELOPMENT OF PROPERTIES
LOCATED AT 1137 E. BESSIE ST., 951 E. BROADWAY AVE., 1532 E.
HATTIE ST., AND 1401 E. LEUDA ST ; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, on November 4, 1997, the City of Fort Worth enacted Ordinance
No 13217, placing a moratorium on the acceptance of applications to zone or develop
properties located at 1137E Bessie Street, 951 E Broadway Avenue, 1532E Hattie
Street and 1401 E Leuda Street;
WHEREAS, substandard buildings located on such properties have been
demolished by the City of Fort Worth,
WHEREAS, the moratorium was enacted to preserve the status quo pending
rezoning of such properties by the City of Fort Worth,
WHEREAS, the City Council approved applications to rezone the four properties
to "A" one-family on January 13, 1998,
WHEREAS, it is advisable to repeal the moratorium in order to remove
impediments to the development of the properties,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS, AS FOLLOWS:
SECTION 1.
The moratorium on acceptance or processing of applications for zoning or
development of the properties described below, which was adopted on November 4,
1997, by Ordinance No 13217, is hereby repealed The affected properties are the
following

SECTION 2.
This ordinance shalt be cumulative of all provisions of ordinances and of the
Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions
of this ordinance are in direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and such Code are
hereby repealed
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if
any phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section

This ordinance shall be in full force and effect from and after its passage

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance which would repeal a moratorium
on acceptance of applications to rezone or develop the properties at 1137 E. Bessie Street, 951 E.
Broadway Avenue, 1532E Hattie Street and 1401 E. Leuda Street.

On November 4, 1997 (M&C G-12042), the City Council enacted a 180 day moratorium on the
acceptance of applications to rezone or redevelop the properties at 1137E Bessie Street, 951 E.
Broadway Avenue, 1532 E. Hattie Street and 1401 E Leuda Street. The moratorium was enacted in
connection with demolition of substandard structures located on such properties and initiation by the
City of applications to rezone the properties. The purpose of the moratorium was to maintain the status
quo pending completion of the rezoning The moratorium ordinance provided that the moratorium
would remain in effect for 180 days or until the City Council adopts an ordinance repealing the
moratorium, whichever occurs first.
All structures on the properties have been demolished The City Council approved rezoning of all four
properties to "A" one-family on January 13, 1998 The attached ordinance will repeal the moratorium
so that there will be no impediment to development of the properties.
