HomeMy WebLinkAboutOrdinance 13575.. ~,_ , ORDINANCE NO ~ ~ ~ G-s AN ORDINANCE AMENDING SECTIONS 35-56(g) and 35-56(h) OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY REVISING AND ADDING CERTAIN RATES AND CHARGES, MAKING THIS ORDINANCE CUMU- LATIVE OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH, PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH. SECTION 1 That Section 35-56(g) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, is hereby amended to be and read as follows (g) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers the furnishing water to such customers. RATE FOR WHOLESALE WATER SERVICE Volume ($11,000 gallons)* $0 4169 Maximum Day ($/MGD excess} $80,056 Maximum Hour ($/MGD excess) $ 0 Customer ($/MeterlMonth) $ 25 00 *plus raw water cost SECTION 2 That Section 35-56(h) of Chapter 35 of the Code of the City of Fort Worth (1986) as amended, is hereby amended to be and read as follows (h) the following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing wastewater services to such customers RATE FOR WHOLESALE WASTEWATER SERVICE Volume ($/1,000 gallons) $0 5258 BOD ($/pound) $0.2057 TSS ($/pound) $0 1714 Customer ($/month) $ 75 00 SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinance and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent ~unsdiction, such unconstitutionality shall not affect any remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall take effect and be m full force and effect for usage from and after October 1, 1998, and it is so ordained. For fiscal year 1999, the wholesale water cost of service study was completed by Water Department staff based on the 1996 wholesale water cost of service study by Deloitte and Touche, LLP Black & Veatch, LLP, completed the wholesale wastewater cost of service study The result of these studies indicated the rates, as proposed below, will recover the costs of providing wholesale water and wastewater service A joint meeting of the Wholesale Water Advisory Committee and the Wholesale Wastewater Advisory Committee was held July 23, 1998, to present the studies and the rate requirements.
