AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS BY $66,523.25 IN THE SPECIAL ASSESSMENTS FUND
AND IN THE STREET IMPROVEMENTS FUND FROM AVAILABLE FUNDS
FOR THE PURPOSE OF FUNDING A CONTRACT WITH MCMAHON
CONTRACTING, INC., FOR CONSTRUCTION OF NORTH RIVERSIDE DRIVE
FROM WESTERN CENTER BOULEVARD TO 823 FEET NORTH, PROVIDING
FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1997/98 and in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations by $66,523.25 in
the Special Assessments Fund and in the Street Improvements Fund from available funds for the purpose of
funding a contract with McMahon Contracting, Inc., for construction of North Riverside Drive from Western
Center Boulevard to 823 feet north.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any
reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the
remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and
remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 13111 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict with
such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances
and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so
ordained.

deed recorded in Volume 11177, Page 1934, Deed Records, Tarrant County, Texas and being more
_particularly described as follows:
BEGINNING at a mark "x" found in concrete for the northeast corner of said tract and being in the
present existing westerly right-of--way line of N. Riverside Drive as dedicated according to the plat of
Summerfields Addition Phase V as recorded in Volume 388-178, Page 37, Plat Records, Tarrant
County, Texas.,
THENCE. With the east line of said tract and said present west right-of--way line, South Ol degrees
41 minutes 07seconds East, 771 75' feet to a 1/2" iron rod with cap stamped "Landes & Assoc."
found at its intersection with the existing north right-of--way line of Western Center Blvd. from which
the southwest corner of the right-of--way dedication as shown on said plat bears (by deed call) South
01 degrees 41 minutes 07 seconds East, 106.95' feet and being in the centerline of Western Center

THENCE. With said north right-of -way line, South 88 degrees 18 minutes 26 seconds West, 67.54'
feet to a 1/2" iron rod with cap stamped "Landes & Assoc." found at the beginning of anon-tangent
curve to the right the center of which bears North 67 degrees 59 minutes 16 seconds West, a radius
distance of 90.0' feet;
THENCE. Southwesterly, with said curve to the right an arc distance of 100.57' feet to a point at its
end said point being on the top of a light and signal pull box from which a 5/8" iron rod with red
plastic cap stamped "CITY-FT-WORTH SURVEY SECTION" set bears South 86 degrees 09
minutes IO seconds West, 12.25' feet;
THENCE. Continuing with said north right-of--way line, South 86 degrees 09 minutes 10 seconds

red plastic cap stamped "CITY-FT-WORTH SURVEY SECTION" set at the intersection of the
existing north right-of--way line of Western Center Blvd. with the proposed westerly right-of--way line
of N. Riverside Dr said iron rod also being at the beginning of a curve to the left the center of which

THENCE. With said proposed westerly right-of--way line and said curve to the left an arc distance of
137.98' feet to a 518" iron rod with red plastic cap stamped "CITY-FT-WORTH SURVEY
SECTION" set at its end, said iron rod being 72.0' feet west of and perpendicular to the centerline
according to the paving plans file no. K-1385, on file in the Engineering Department, City of Fort
Worth,

RECOMMENDATION
it is recommended that the City Council
1 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by
$66,523.25 in the Special Assessments Fund and in the Street Improvements Fund from available
funds, and
2. Approve a $66,523.25 fund transfer for the property owner's share of construction costs from the
Special Assessments Fund to the Street Improvements Fund, and
3 Authorize the City Manager to execute a contract with McMahon Contracting, Inc., in the amount
of $160,047 57 for the construction of North Riverside Drive (Western Center Blvd to 823 feet
north), and
4 Authorize the City Manager to execute the attached Letter of Agreement with Westgold Realtor's,
Inc., setting the terms for payment of assessments levied, and
5 Accept the dedication deed for street right-of-way from Westgold Realtors, Inc. for a total cost of
$1 00
DISCUSSION
North Riverside Drive (the west lane) is proposed to be improved by constructing aseven-inch thick
reinforced concrete pavement with aseven-inch high attached concrete curb on a six-inch thick lime
stabilized subgrade so that the finished roadway will match the existing section of N Riverside Drive to
the north The width of the new roadway will be twenty-six feet wide from the outside curb to the
median The completed street will consist of double twenty-six foot wide roadways with a variable width
raised median within a one hundred twenty foot wide right-of-way
The street construction was authorized on May 23, 1995 (M&C G-11100) and October 17, 1995 (G-
11260) There were also two Benefit Hearings on this project dated June 13, 1995 (M&C BH-0141) and
November 14, 1995 (M&C BH-0151)
The project was advertised on February 26 and March 5, 1998 The following bids were received on
March 26, 1998

McMahon Contracting, Inc. is in compliance with the City's M/WBE Ordinance by committing to 13%
M/VVBE participation and documenting a good faith effort. McMahon Contracting, Inc., is performing all
aspects of the project with their own forces except in 5 areas They have subcontracted in all 5 areas
to M/WBE firms. The City's goal on this project is 17%.
The letter of agreement between the City and Westgold provides for the dedication of necessary right-
of-way for the project, as well as a schedule of payment for previously levied assessments (BH-0151)
The dedication is needed for the construction, use, maintenance repair and construction of North
Riverside Drive The street right-of-way is located in northeast Tarrant County and is more fully
described as follows.

This project is located in COUNCIL DISTRICT 4, Mapsco 35Z.
Because the City has yet to appropriate New Development funds approved during the 1998 Capital
Improvement Program (CIP), the City's share of construction costs ($93,524.32) will be funded from
surplus (Pre 1990) bond funds. Once the City Council has appropriated the '98 CIP New Development
funds, the City's expenditures for this project will be moved to the '98 New Development Fund
FISCAL INFORMATION/CERTIFICATION
The Director of the Department of Finance certifies that upon adoption of the attached appropriation
ordinance and completion of the above recommendations, funds will be available in the current capital
budgets, as appropriated, of the Street Improvements Fund
