HomeMy WebLinkAboutOrdinance 13480ORDINANCE NO r,~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS BY $66,523.25 IN THE SPECIAL ASSESSMENTS FUND AND IN THE STREET IMPROVEMENTS FUND FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH MCMAHON CONTRACTING, INC., FOR CONSTRUCTION OF NORTH RIVERSIDE DRIVE FROM WESTERN CENTER BOULEVARD TO 823 FEET NORTH, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1997/98 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations by $66,523.25 in the Special Assessments Fund and in the Street Improvements Fund from available funds for the purpose of funding a contract with McMahon Contracting, Inc., for construction of North Riverside Drive from Western Center Boulevard to 823 feet north. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 13111 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Approve a $66,523.25 fund transfer for the property owner's share of construction costs from the Special Assessments Fund to the Street Improvements Fund, and 3 Authorize the City Manager to execute a contract with McMahon Contracting, Inc., in the amount of $160,047 57 for the construction of North Riverside Drive (Western Center Blvd to 823 feet north), and 4 Authorize the City Manager to execute the attached Letter of Agreement with Westgold Realtor's, Inc., setting the terms for payment of assessments levied, and 5 Accept the dedication deed for street right-of-way from Westgold Realtors, Inc. for a total cost of $1 00 DISCUSSION North Riverside Drive (the west lane) is proposed to be improved by constructing aseven-inch thick reinforced concrete pavement with aseven-inch high attached concrete curb on a six-inch thick lime stabilized subgrade so that the finished roadway will match the existing section of N Riverside Drive to the north The width of the new roadway will be twenty-six feet wide from the outside curb to the median The completed street will consist of double twenty-six foot wide roadways with a variable width raised median within a one hundred twenty foot wide right-of-way The street construction was authorized on May 23, 1995 (M&C G-11100) and October 17, 1995 (G- 11260) There were also two Benefit Hearings on this project dated June 13, 1995 (M&C BH-0141) and November 14, 1995 (M&C BH-0151) The project was advertised on February 26 and March 5, 1998 The following bids were received on March 26, 1998 BIDDERS M NT TIME OF COMPLETION McMahon Contracting. The City's goal on this project is 17%.
