AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
GRANTS FUND IN THE AMOUNT OF $345,500 00 FROM AVAILABLE FUNDS FOR THE
PURPOSE OF FUNDING AN AMENDED AGREEMENT WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION FOR IMPROVEMENTS TO THE CLEARFORK/BENBROOK BIKE TRAIL,
PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH,
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS.
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1997-98 and in the Budget of
the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of
$345,500 00 from available funds for the purpose of funding an amended agreement with the Texas Department of
Transportation for improvements to the ClearforklBenbrook Bike Trail.
SECTION 2:
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a
court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or
parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 13111 and all other ordinances and appropriations amending the
same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and
appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly
repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained.

STREAMS AND VALLEYS, INC AND APPROPRIATION ORDINANCE
RECOMMENDATION
It is recommended that the City Council
Authorize the City Manager to execute an amendment in the amount of $345,500 to the agreement
with Texas Department of Transportation for improvements to the Clearfork/Benbrook Bike Trail
with a revised project cost of $1,033,000, and
2 Accept a donation of $159,550 from Streams and Valleys, Inc. to fund the local share of the
estimated engineering construction and state administrative costs for the Clearfork/Benbrook Bike
Trail Project; and
3 Authorize the City Manager to transfer funds in the amount of $34,550 from the Special Trust Fund
to the Grants Fund, and
4 Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations by
$345,500 in the Grants Fund from available revenues
DISCUSSION
On July 21,1992 (M&C G-9738), the City Council approved the 1993 Transportation Improvement
Program (T I P) which included a number of bikeway projects This approval made these projects
eligible for funding under the Intermodel Surface Transportation Efficiency Act of 1991 (ISTEA) In late
1992, the Texas Department of Transportation (TxDOT) accepted the Clearfork/Benbrook Bike Trail
Project as a funded project under the Congestion Mitigation and Air Quality (CMAQ) program of ISTEA.
The total project cost estimated at that time was $687,500 The local share of 20% was committed by
Streams and Valleys, Inc.
On February 21, 1995 (M&C C-14702), the City Council authorized the City Manager to execute an
agreement with TxDOT for improvements to the Cleartork/Benbrook Bike Trail in the amount of
$687,500 Part of the approval included acceptance of a donation of $12,500 from Streams and
Valleys, Inc. to fund the local share of the estimated engineering costs and state administrative costs
for the trail projects
On December 17, 1996 (M&C C-15829), the City Council authorized the execution of an engineering
agreement with Halff Associates, Inc. to prepare plans, specifications and cost estimates for the

On August 4, 1998, the TxDOT -Austin office received construction bids for the development of the 3 6
mile (5 752 kilometer) Clearfork/Benbrook Bike Trai( The low bid was submitted by Linder-Stahl
Construction Company, Inc. of Fort Worth in the amount of $838,176 90 Utilizing this construction cost
figure, the revised project budget is as follows
Engineering Cost (Halff) $ 82,250 00
TxDOT's Preliminary Engineering, Administration 30,133 45
TxDOT's Indirect Cost 2,712.01

TxDOT's Construction Management and Inspection Cost 79.626.81
Total $1,032,899 17
The revised project cost exceeds the original Metropolitan Planning Organization (MPO) authorization
of $687,500 by $345,500 The MPO has agreed to increase the authorization of CMAQ funds and
modify the TIP With this revision, the City of Fort Worth and/or Streams and Valleys, Inc. is
responsible to meet the increase in the focal share of 20% of the project cost. The total local share now
becomes $206,600
To address the overrun of the local share, it is proposed that the City appropriated a total of $34,550
toward the project. These funds were appropriated from the 1997 Mayfest appropriations to the City,
approved for this use by the City Council on September 1, 1998, (M&C G-12318) The following
outlines the funding of the local share..
City Contribution $ 34,,550 00
Streams and Valleys, Inc. donation for engineering 12,500 00
(received February 1995)
Streams and Valleys, Inc. donation for construction and administration $159.550.00
Total Local Share $206,600 00
With the additional appropriations from the MPO and local share increase, the project is scheduled to
begin construction in October,1998 It is estimated that the construction phase will take approximately
seven months and the trail would be open for public use in May, 1999
This project will have an annual operational impact on the General Fund budget beginning in FY 1998-
99 in the amount of $ 4,800
The portion of the Clearkfork/Benbrook Trail, which is within the City of Fort Worth, is in COUNCIL
