ORDINANCE NO. ~ ~~~~ AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A PORTION OF A UTILITY EASEMENT LOCATED ON BLOCKS 1,2,3 AND 6, CHAPEL RIDGE ADDITION, PHASE 1, TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following utility easement, and as more specifically described in the Exhibits attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished 1 A 5 foot wide segment of a 15 foot wide utility easement located on Lot 1, Block 6, Chapel Ridge Addition, Phase I, as recorded in Volume 7977, Page 948, Deed Records of Tarrant County, Texas, and containing 1,746 square feet; and 2 A 5 foot wide segment of a 15 foot wide utility easement as recorded in Volume 7977, Page 948, Deed Records of Tarrant County, Texas, and situated in the Nancy Casteel Survey, Abstract No 349, situated within the west part of Fort Worth in Tarrant County, Texas and being a portion of a tract as described by deed to 58- Chapel Creek Ltd and recorded in Volume 11821, Page 1963, said Deed Records, also located on Blocks 1, 2, 3 and 6, Chapel Ridge Addition, Phase 1 and containing 4,868 square feet. SECTION 2. That the fee to the land in the above described vacated utility easements is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. BEING a part of an existing 15 foot utility easement as recorded in Volume 7977, Page 948, Deed Records, Tarrant County, Texas, and situated in the Nancy Casteel Survey, Abstract No 349, situated within the west part of Fort Worth in Tarrant County, Texas, and being a portion of Tract II as described by deed to Highway 80 Joint Venture and recorded in Volume 9806, Page 1366, said Deed Records, said easement abandonment being more particularly described by metes and bounds as follows: COMMENCING at a'/z" iron rod found at the intersection of the northerly right-of-way line of U S. A five foot wide (5') segment of a fifteen foot (15') wide utility easement as recorded in Volume 7977, Page 948, Deed Records of Tarrant County, Texas, and being a portion of a tract as described by deed to 58-Chapel Creek, Ltd ,and recorded in Volume 11821, Page 1963 of said deed records, and containing 4,868 square feet. DISCUSSION T W Reilly, III, President of 58-Chapel Creek, Ltd , by Sunrise Partners, General Partner, ,and David L. Moritz, Managing General Partner of Highway 80 Joint Venture, by Moritz Interests, Ltd ,owners of the subject property, have requested that the above described easements be vacated so as to remove said easements from the encompassing "A" Single=Family zoned lots, and a "C" Multi-Family zoned, lot. Arrangements have been made for the relocation of an existing water line. Reviewing City departments and public utility companies have raised no objections to this request, and the satisfactory replat has been submitted (case file number PP-96-076), which includes a new easement dedication for said utility _ __. -- This request is located in COUNCIL DISTRICT 3 F~S~=Q~ INFORMATION/CERTIFICATION The Land Agent for the City of Fort Worth has determined that said easements .were previously purchased by separate instruments by the City and that a fee of one dollar ($1 00) satisfies the City's interests.
