HomeMy WebLinkAboutOrdinance 13390ORDINANCE NO. j3~~~ AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A FIVE FOOT (5') WIDE SEGMENT OF A TEN FOOT (10') UTILITY EASEMENT, STONE GLEN AT FOSSIL CREEK, PHASE 2 ADDITION, TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES iN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS• SECTION 1. THAT the east 5 foot of a 10 foot wide utility easement containing approximately 520 square feet in area, and located along the west lot line of Lot 31, Block W, Stone Glen at Fossi! Creek, Phase 2, as recorded in Cabinet A, Slide 2402, Plat Records of Tarrant County, Texas, and as more specifically described in Exhibit "A" attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. DISCUSSION David Weekley Homes, 3500 Stone Creek Way, owner of the subject property, has requested that the City vacate the above described easement so as to facilitate the construction of a house deck. Satisfactory arrangements have been made by the owner for the relocation of the Marcus Cable utility found in said easement. Reviewing City departments and other public utility companies have raised no objections to this request.
