I.~ ~ 9 / AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A SIXTY FOOT (60') WIDE PRIVATE ACCESS DRIVE AND UTILITY EASEMENT, FOSSIL CREEK ESTATES, TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS• SECTION 1. THAT the 60 foot wide by 670 foot long segment of a private access drive and utility easement containing 40,200 square feet, located on Lot 1, Block 4, Fossil Creek Estates, as recorded in Cabinet A, Slide 3523 and 3524, Plat Records of Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished SECTION 2. That the fee to the land in the above described vacated private access and utility easement is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. ACCESS DRIVE AND UTILITY EASEMENT (VA-97-066) LOT 1, BLOCK 4 OF FOSSIL CREEK ESTATES, FORT WORTH ETJ RECOMMENDATION It is recommended that the City Council adopt the attached Ordinance vacating a 60' wide by 670' long segment of a private access drive and utility easement, containing 40,200 square feet in Fossil Creek Estates, as recorded in Cabinet A, Slide 3523 and 3524, of the Plat Records of Tarrant County, Texas. DISCUSSION Goodwin and Marshall, Inc., 6001 Bridge Street, Suite 100, has requested that the City vacate the above described combined access drive and utility easement, to allow replatting with adjoining land The portion of subject easement to be vacated was acquired by dedication and contains no existing utilities or roadway Reviewing City departments and public utility companies have raised no objection to this request. A satisfactory replat has been submitted (FS-97-186), which includes new utility easement dedications.
