AN ORDINANCE AMENDING PARTS "INSPECTION AND TESTING FEES"
OF APPENDIX VII-B OF THE UNIFORM FIRE CODE OF 1991, BY
AMENDING SUBSECTION (b) "FIRE CODE," OF SECTION 13-2, ARTICLE I,
CHAPTER 13, "FIRE PREVENTION AND PROTECTION" OF THE CODE OF
THE CITY OF FORT WORTH, TEXAS (1986), AS AMENDED, TO PROVIDE
A SCHEDULE OF FEES FOR FALSE ALARMS AT COMMERCIAL
ESTABLISHMENTS IN EXCESS OF TWO IN ANY TWELVE MONTH
PERIOD, PROVIDING A SEVERABILITY CLAUSE, MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING
ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING
AND EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
Subsection (b) "Fire Code" of Section 13-2 "Same--Amendments," of Article I of Chapter 13 of
the Code of the City of Fort Worth, Texas (1986) as amended, is hereby further amended by
amending Part 7 "Special Fees" of Appendix VII-B of the Uniform Fire Code of 1991,
constituting a local amendment to the Uniform Fire Code of 1991, to read as follows
7 Special Fees. A special fee shall be charged for those items listed below, according to
the following schedule
(a) Permits required by the Fire Code (see Chapter 4)
(b) False alarms at commercial establishments in excess of two
in any twelve month period
(c) Official fire reports
(d) Knox lock rentals
(e) Knox lock deposits

SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are
in direct conflict with the provisions of such ordinances and such Code, in which event conflicting
provisions of such ordinances and such Code are hereby repealed.
SECTION 3
It is hereby declared to be the intention of the Crty Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation m th2s ordinance of any
such unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4
This ordinance shall take effect and be m full force and effect from and after October 1st,
1998, and it is so ordained.

RECOMMENDATION
It is recommended that the City Council approve the attached ordinance amending Chapter 13 of the
City Code, implementing a rate of $100 for commercial entities for false alarms in excess of two in any
twelve month period, effective October 1, 1998
DISCUSSION
Currently the City does not have a fire false alarm fee, only an installation charge based on the number
of devices installed. However, the City responds to an estimated 2,040 commercial false alarms per year
In June 1997, a review of fire false alarm services was conducted utilizing information provided in the
Municipal Fee Survey for North Central Texas (April 1998) prepared by the North Central Texas Council
of Governments, a survey, and telephone interviews with various cities In comparing the City's fee
structure, it was found that several cities had a fee structure for false alarm services It was also found
that an established rate could potentially generate approximately $102,000 in revenue for the City A
fee of $100 for commercial is being recommended to the City Council to generate revenue to offset the
Fire Department's overtime costs.
