ORDINANCE NO ~~
AN ORDINANCE AMENDING SECTION 34-119 "FEE, WHEN FEE
PAYABLE" OF ARTICLE IV "TAXICABS" OF CHAPTER 34 "VEHICLES
FOR HIRE"" OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986),
AS AMENDED, INCREASING THE ANNUAL STREET RENTAL FEE TO
TWO HUNDRED DOLLARS ($200), PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE, PROVIDING FOR A SEVERABILITY CLAUSE,
AND PROVIDING AN EFFECTIVE DATE.
Be it ordained by the City Council of the City of Fort Worth, Texas that:
SECTION 1
Section 34-119 "Fee; when fee payable" of Chapter 34 "Vehicles for Hire" of the Code of
the Cary of Fort Worth, Texas (1986), as amended, is hereby amended, and after having been
amended shall read and be as follows.
Sec. 34-119 Fee; when fee payable.
(a) As compensation or rental or license fee for the privilege of operating upon and using the public
streets, alleys and thoroughfares of the city m conducting and carrying on the business of
transporting passengers for compensation on and over such streets and thoroughfares m taxicabs,
each holder of a franchise or grant made under the terms of this chapter shall pay to the city at the
office of public utilities, on or before January 1 of each calendar year during which the grant or
franchise is in effect, an annual "street rental" fee equal to two hundred dollars ($200 00) for each
cab which the franchise holder is authorized to operate under his franchise or grant of privilege. In
the event the franchise or grant of privilege begins or ends on a date other than January 1, then the
annual payment to the city shall be prorated on the basis of fifty dollars ($50 00) per cab per quarter
of a year during which the franclise or grant of privilege is in effect.
(b) The fees provided for m this section shall be m lieu of all other fees to be paid by taxicab
operators under or imposed by any other ordinance now m force, but shall not be construed to be in
lieu of any validly assessed ad valorem taxes.
SECTION 2.
Tlis ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of thus ordinance are m

direct conflict with the provisions of such ordinances and such Code, m which event conflicting
provisions of such ordinances and such Code are hereby repealed.
SECTION 3
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the
valid judgment or decree of any court of competent ~unsdiction, such voidness, ineffectiveness or
unconstitutionality shall not effect any of the remauung phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City Council without the
incorporation m this ordinance of any such void, ineffective or unconstitutional phrase, clause,
sentence, paragraph or section.
SECTION 4
This ordinance shall take effect and be in full force and effect 30 days after its passage, and it is
so ordained.

SUBJECT AMEND TAXICAB FEES
RECOMMENDATION
It is recommended that the City Council approve the attached ordinance amending Chapter 34,
"Vehicles for Hire", of Article IV, "Taxicabs", of Section 34-119 of the City Code as follows.
Approve the annual street rental fee for taxicabs that use the public streets, alleys, and
thoroughfares of the City, to two hundred dollars ($200) per vehicle that operates under
the authority of the franchise holder
DISCUSSION
In 1995, the City Council approved an ordinance that increased the taxicab street rental fee to $120
Currently, the 1997-98 revenue budget for taxicab street rental fees is $5,000 Previously, the fee was
based on the number of cabs in service per month for calendar quarters
A review of taxicab street rental fees was conducted utilizing information provided in the April, 1998
issue of the Municipal Fee Survey for North Central Texas prepared by the North Central Texas Council
of Governments In comparing fees associated with the City of Fort Worth, it was found that the City's
fee ranked below several other cities, including Dallas ($250), Arlington ($180), and Mesquite ($500)
The annual fee from the taxicab franchise shall be received on/or before January 1 of each calendar
year during which the franchise is in effect. In the event the franchise begins or ends on a date other
than January 1, then the annual payment to the City shall be prorated on the basis of $50 per cab, per
quarter, of a year during which the franchise is in effect.
FISCAL IMPACT - To support the service level improvement, the following fee changes are proposed

Increase in street rental fees of taxicabs from $120 to $200
150 taxicabs X $80 increase
Annual Estimated Additional Revenue $12,000
FISCAL INFORMATION/CERTIFICATION
The Department of Finance will be responsible for collecting and depositing all applicable fees
