HomeMy WebLinkAboutOrdinance 12903 Ordinance No. AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND AWARDED ASSETS IN THE AMOUNT OF $20,000 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING PARALEGAL SERVICES FOR NUISANCE ABATEMENT PROSECUTIONS, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1996-97 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund Awarded Assets in the amount of $20,000 00 from available funds for the purpose of funding paralegal services for nuisance abatement prosecutions. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 12629 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. It is recommended that the City Council 1 Adopt the attached appropriations ordinance increasing estimated receipts and appropriations by 520,000 from available funds in the Special Trust Fund Awarded Assets, and 2 Approve the expenditure of 520,000 from Awarded Assets to be used as matching funds for the Office of the Texas State Attorney General to assist in pursuing public and common nuisances DISCUSSION. The Office of the Texas State Attorney General (OAG) provides assistance to local law enforcement agencies in pursuing public and common nuisances helping to reduce crime in some areas by providing civil remedies through the nuisance abatement process Currently, the OAG has two (2) paralegals assigned to final case preparation and Fort Worth utilizes this process more than any other city Of the cases investigated and successfully prosecuted throughout the state, 33% were for the City of Fort Worth Previously the paralegals were funded by a federal grant and municipal matching funds Fort Worth contributed 515,000 in 1995 However, the federal grant has expired and will not be renewed The OAG is asking for assistance with funding and they have requested 520,000 from the City of Fort Worth Without financial support the OAG will have to cut back on its assistance which could result in fewer cases presented for abatement, or not presented at all The nuisance abatement process has been a successful tool for law enforcement agencies to use to rid neighborhoods of public and common nuisances which contribute to criminal activity S„ ~~ij _f !~'~ '~ ... 4 t ~ ~ f.
