AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
GRANTS FUND IN THE AMOUNT OF $98,540.00 SUBJECT TO THE RECEIPT OF THE GRANT
FROM THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION FOR THE PURPOSE
OF FUNDING THE AIR POLLUTION CONTROL PROGRAM, PROVIDING FOR A SEVERABILITY
CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1996-97 and in the Budget of
the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of
$98,540 00 subject to the receipt of the grant from the Texas Natural Resource Conservation Commission for the purpose of
funding the Air Pollution Control Program.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a
court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or
parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 12629 and all other ordinances and appropriations amending the
same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and
appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly
repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained.

SIIBJECT APPROPRIATION ORDINANCE FOR THE AIR POLLUTION CONTROL GRANT FOR FY
97-98
RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to submit an application for, and accept if offered, a grant
from the Texas Natural Resource Conservation Commission (TNRCC) for the Department
of Environmental Management's Air Pollution Control Program in the amount of
598,540 00, and
2 Authorize anon-interest bearing interfund loan from the General Fund to the Grant Fund
in the amount of 524,635 00 for interim financing of 25 % of this grant project pending
contract execution, and
3 Adopt the attached appropriation ordinance increasing estimated receipts and
appropriations in the Grant Fund by 598,540 00 subject to receipt of the grant, and
4 Apply indirect costs in accordance with the City's Administrative Regulation 3-15,
applying the most recently approved rate of 24 17% for Environmental Management, not
to exceed 516,907 00, which is included in the grant amount of 590,540 00, and
5 Authorize the use of 539,416 00 in the General Fund as an in-kind match for this grant
DISCUSSION
The TNRCC is now the pass-through agency for all Environmental Protection Agency (EPA-
Section 105 grant funds The EPA Section 105 grant funds have been received annually by
the City's Air Pollution Control Program The City's Air Pollution Control .Program, in
cooperation with the Texas Natural Resource Conservation Commission, enforces the Federal
and State Clean Air Act provisions within the city limits of Fort Worth This includes periodic
inspections of specific emission sources, daily monitoring of ozone and particulate levels, and
complaint investigation
This grant requires a local in-kind match The City's proposed General Fund budget for FY
1997-98 will include $39,416 00 as matching funds for this grant The interim funding of
524,635 00 will be returned to the General Fund upon execution of a grant contract with the
TRNCC
No City funds will be expended before the grant is approved Upon approval and acceptance
of the grant, City funds will be expended before receipt of grant funds

The Director of Fiscal Services certifies that u pon approval of the above recommendations,
adoption of the attached appropriation ordinance, and receipt of the grant contract, funds will
be available in the current operating budget, as appropriated, of the Grant Fund Upon
execution of the grant contract, the interfund loan of 524,635 00 will be returned to the
General Fund
