HomeMy WebLinkAboutOrdinance 13212r Ordinance No. ~ ~ o7i ~ AN ORDINANCE INCREASING THE ESTIMATED RECEII'TS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $10,420.00 AND IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $24,315.00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN ENGINEERING AGREEMENT TO WEIR AND ASSOCIATES, INC. FOR STREET RECONSTRUCTION AND WATER AND SEWER LINE REPLACEMENTS ON BONNIE BRAE AVENUE, PROVIDING FORA SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1997-98 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in Water Capital Projects Fund in the amount of $10,420.00 and in the Sewer Capital Projects Fund in the amount of $24,315 00 from available funds for the purpose of funding an engineering agreement to Weir and Associates, Inc., for street reconstruction and water and sewer line replacements on Bonnie Brae Avenue. SECTION 2. 0000 That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13111 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY ~~~1~~ Assistant City Attorney Date Adopted ~~ ~ ~~~~ r Effective City of Fort worth, Texas Mayor and Council Communication REFERENCE NUMBER LOG NAME PAGE. 10/28/97 **C-16398 30BONNIE 1 of 2 svBJECT ,ADOPTION OF APPROPRIATION ORDINANCE AND AWARD OF ENGINEERING SERVICES AGREEMENT TO WEIR & ASSOCIATES, INC ,FOR STREET RECONSTRUCTION AND WATER AND SEWER REPLACEMENTS ON BONNIE BRAE AVENUE FROM TOM ELLEN ROAD TO NE 28TH STREET RECOMMENDATION It is recommended that the City Council 1 Authorize the transfer of 534,735 00 from the Water and Sewer Operating Fund to the Water Capital Project Fund (510,420 00) and Sewer Capital Project Fund (524,315 00), and 2 Adopt the attached appropriation ordinance increasing. estimated receipts and appropriations in the Water Capital Project Fund in the amount of 510,420 00 and the Sewer Capital Project Fund in the amount of 524,315 00 from available funds, and 3 Authorize the City Manager to execute an engineering services agreement with Weir & Associates, Inc ,Consulting Engineering, for a lump sum fee of 588,000 00 to prepare plans and specifications for street, water and sanitary sewer improvements on Bonnie Brae Avenue from Tom Ellen Road to N E 28th Street DISCUSSION The Department of Transportation and Public Works has determined that the existing pavement on Bonnie Brae Avenue from Tom Ellen Road to N E 28th Street is in poor condition and street reconstruction and drainage improvement is needed The consultant proposes to prepare construction plans and specifications for paving, drainage, water and sewer improvements utilizing the City's current design standards and policy guidelines Funding for the paving and drainage improvements was made available from the 1993 Capital Improvement Program upon cancellation of the N Beach Street project by the City Council Weir & Associates, Inc ,proposes to perform the design work for this project for a total lump sum fee of 588,000 00 of which 554,600 00 will be paid to prepare plans and specifications for paving and drainage improvements Staff has reviewed this proposal and considers this fee to be reasonable for the scope of services proposed An additional 51,335 00 is required for Department of Engineering review of water and sewer on this project Printed on Recyded Paper City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME.
