AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $411,649 00 AND IN THE SEWER
CAPITAL PROJECTS FUND IN THE AMOUNT OF $79,222.00 FROM AVAILABLE FUNDS FOR
THE PURPOSE OF FUNDING CONTRACT TO CONATSER CONSTRUCTION, INC., FOR WATER
MAIN AND SEWER REPLACEMENT IN WARNER ROAD, PATTON COURT, BEN HALL COURT,
SEVENTH AVENUE, AND HURLEY AVENUE, PROVIDING FOR A SEVERABILITY CLAUSE,
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL
PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS.
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1996-97 and in the Budget of
the City Manager, there shall also be increased estimated receipts and appropriations m the Water Capital Projects Fund in the
amount of $411,644 00 and in the Sewer Capital Projects Fund in the amount of $79,222.00 from available funds for the
purpose of funding a contract to Conatser Construction, Inc., for water main and sewer replacement in Warner Road, Patton
Court, Ben Hall Court, Seventh Avenue, and Hurley Avenue.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a
court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or
parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 12629 and all other ordinances and appropriations amending the
same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and
appropriations, in which instance said conflicting provisions of said pnor ordinances and appropriations are hereby expressly
repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained.

SUBJECT APPROPRIATION ORDINANCE AND AWARD OF CONTRACT TO CONATSER
CONSTRUCTION, INC ,FOR WATER MAIN AND SEWER REPLACEMENT IN
WARNER ROAD (PARK PLACE TO WINDSOR), PATTON COURT (WARNER ROAD TO
EAST CUL-DE-SAC), BEN HALL COURT (WARNER ROAD TO EAST CUL-DE-SAC),
SEVENTH STREET (MAGNOLIA AVENUE TO MYRTLE STREET), AND HURLEY
AVENUE (W ARLINGTON TO ELIZABETH STREET)
RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to transfer $490,871 00 from the Water and Sewer
Operating Fund to the Water Capital Projects Fund in the amount of 541 1,649 00
and Sewer Capital Projects Fund in the amount of 579,222 00, and
2 Adopt the attached appropriations ordinance increasing estimated receipts and
appropriations in the Water Capital Projects Fund in the amount of 541 1,649 00 and
the Sewer Capital Projects Fund in the amount of 579,222 00 from available funds,
and
3 Authorize the City Manager to execute a construction contract with Conatser
Construction, Inc , in the amount of 5424,520 00 for water and sanitary sewer fine
replacements in Warner Road (Park Place to Windsor), Patton Court (Warner Road
to East Cul-de-sac)., Ben Hall Court (Warner Road to East Cul-de-sac), Seventh Street
(Magnolia Avenue to Myrtle Street), and Hurley Avenue (W Arlington to Elizabeth
Street)
DISCUSSION,
The 1993 Capital Improvement Program included funds for the reconstruction of Warner
Road (Park Place to Windsor), Patton Court (Warner Road to East Cul-de-sac), Ben Hall
Court (Warner Road to East Cul-de-sac1, Seventh Street (Magnolia Avenue to Myrtle
Street), and Hurley Avenue (W Arlington to Elizabeth Street) The Water Department has
determined that the water and sanitary sewer lines should be replaced prior to the street
reconstruction
The work to be performed under this contract includes the replacement of 3,020 L F of
8" water line, 1,260 L F of 24-inch water line, and 535 L F of 8" sanitary sewer lines
and related appurtenances
The project was advertised in the Fort Worth Star-Telegram on April 3 and April 10, 1997
Bids were received on May 1, 1997 Conatser Construction, Inc was the sole bidder

The contingency for possible change orders is $23,989 00 Conatser Construction, Inc ,
is in compliance with the City's M/WBE Ordinance by committing to 10% M/WBE
participation The City's goal on this project is 8%
In addition to the contract amount, 542,454 00 is required for associated construction
inspection and survey
FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that upon approval and completion of
recommendation 1, and the adoption of the attached appropriations ordinance, funds will
be available in the current capital budgets, as appropriated, of the Water Capital Projects
Fund and the Sewer Capital Projects Fund
