AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
SPECIAL TRUST FUND, AWARDED ASSETS IN THE AMOUNT OF $7,953 00 FROM AVAILABLE
FUNDS FOR THE PURPOSE OF FUNDING THE DISPOSAL OF HAZARDOUS WASTE
CHEMICALS, PROVIDING FORA SEVERABILITY CLAUSE, MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1996-97 and in the Budget of
the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund, Awarded
Assets, in the amount of $7,953.00 from available funds for the purpose of funding the disposal of hazardous waste chemicals.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a
court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or
parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 12629 and all other ordinances and appropriations amending the
same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and
appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly
repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained.

SUBJECT APPROPRIATION ORDINANCE AND CONTRACT WITH PHILLIPS ENVIRONMENTAL
FOR THE DISPOSAL OF CRIME LABORATORY HAZARDOUS WASTE
RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to execute an agreement with Phillips Environmental for the
disposal and court-ordered destruction of hazardous chemicals including some low
concentrations of controlled substances currently being stored in the Police Forensic
Science Laboratory Division at 350 W Belknap Street, Fort Worth, Texas, and
2 Adopt the attached appropriation ordinance increasing estimated receipts and
appropriations by 57,953 00 in the Special Trust Fund, State Awarded Assets from
available funds
DISCUSSION
In the course of the duties of the Police Forensic Science Laboratory Division, numerous
hazardous chemicals have been collected as the result of analysis required to file "Clandestine
Laboratory" narcotics cases In addition to those chemicals collected from clandestine
laboratories, the Police Department Forensic Laboratory Division generates chemical wastes
that accumulate and require environmentally safe disposal/destruction
A court order has been presented to and signed by Judge Harry Hopkins of the 213th Criminal
Distract Court for the destruction of controlled substances identified in the order and currently
in the possession of the Fort Worth Police Department The Forensic Science Laboratory
Division and the Special Operations Division of the Police Department have independently
researched the clandestine lab cases and determined that no criminal charges remain pending
that would require the production of any item of evidence set for destruction under the court
order signed by Judge Hopkins
The Environmental Management Department has identified a waste management company
(Phillips Environmental of Kansas City, Missouri) and has determined that the cost for
packaging, transportation, and disposal of the accumulated hazardous waste will not exceed
57,953 00 The disposal/destruction of these chemical hazardous wastes will be coordinated
with Environmenta{ Management to ensure that all current state and federal environmental
protection. standards are met A certificate of destruction will be required due to the presence
of controlled substance among the items included in this waste
