AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS BY $2,576.00 IN THE SPECIAL ASSESSMENTS FUND
AND BY $2,576.00 IN THE STREET IMPROVEMENTS FUND FROM
AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH
TEXAS TECH CONSTRUCTION, INC., FOR THE RECONSTRUCTION OF
MCKINLEY AVENUE FROM AZLE AVENUE TO 28"-' STREET, PROVIDING
FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1996/97 and in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations by $2,576.00 in
the Special Assessments Fund and by $2, 576.00 in the Street Improvements Fund from available funds for the
purpose of funding a contract with Texas Tech Construction, Inc., for the reconstruction of McKinley Avenue
from Azle Avenue to 28"' Street.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any
reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the
remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and
remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 12629 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict with
such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances
and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so
ordained.

It is recommended that the City Council
1 Adopt the attached appropriation ordinance increasing estimated receipts and
appropriations by 52,576 00 in the Special Assessments Fund and $2,576 00 in the
Street Improvements Fund from available funds, and
2 Approve a 52,576 00 fund transfer for the property owner's share of construction
costs from the Special Assessments Fund to the Street Improvements Fund, and
3 Authorize the City Manager to execute a contract with Texas Tech Construction,
Inc , in the amount of 5228,496 00 and forty (40) working days for the
reconstruction of McKinley Avenue from Azle Avenue to 28th Street
DISCUSSION
McKinley Avenue from Azle Avenue to 28th Street was added to the 1986 Capital
Improvement Program (CIP) in response to a petition from residents and with the
concurrence of the Council member for District 2 The street is in a qualified target area
and has previously been constructed to City standards In the absence of Community
Development Block Grant (CDBG) funds, surplus funds available within the CIP
contingency fund will provide a portion of the construction costs
On August 27, 1996 (M&C BH-0156), the City Council held a benefit hearing and levied
assessments for this project
The street improvements will include the construction of standard concrete pavement,
driveway approaches, and sidewalks where shown on the plans
This project was advertised on May 22 and 29, 1997 The following bids were received
on June 19, 1997

The apparent low bidder, Texas Tech Construction, Inc submitted its bid on a spread
sheet rather than the proposal form contained in the bid documents The apparent low
bidder verified that the bids contained on its spread. sheet conform to the bid items
contained in the proposal Staff recommends that the irregularity of submitting the spread
sheet in lieu of the proposal form be waived
The contingency for possible change orders is S 11,425 00
Texas Tech Construction, Inc , is in compliance with the City's M/WBE Ordinance by
committing to 19% M/WBE participation The City's goal on this project is 18%
This project is located in COUNCIL DISTRICT 2
FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that upon completion of the above
recommendations and the adoption of the attached appropriation ordinances, funds will
be available in the current capital budget, as appropriated, of the Street Improvements
Fund
