HomeMy WebLinkAboutOrdinance 13237Ordinance No. ~ ~j o~ ,3 7 AN ORDIlVANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE NEW DEVELOPMENT FUND IN THE AMOUNT OF $25,000.00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH FANNING AND ASSOCIATES FOR PROFESSIONAL CONSULTING SERVICES, PROVIDING FORA SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1997-98 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the New Development Fund in the amount of $2S,000.00 from available funds for the purpose of funding a contract with Fanning and Associates for professional consulting services. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 13111 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. The special commissioners assessed the damages to the landowner's property and awarded money damages to the landowner (M&C L-11597). Thereafter, the City deposited the award with the court and .proceeded with the construction. The landowner filed objections to the award and appealed to district court. .. .. The lendowner.alleges the interchange has devalued its remaining property greatly in excess of the award °: of the commissioners,.a''~anr~ing°-~and -Associates will provide ~aN~highest~'and~~best"use land plan and `~ ~~' economic impact study to quantify the increase or decrease in value of theaandowners' remaining property because of the .interchange. Department of Transportation for construction ~of the 1=35W Interchange :at ; ;r~ Hillwood Boulevard (Phase t). The Hillwood lnterchange is designated as an "Innovative,Project" under ; the ISTF~4 legislation and the federal share is capped at_.80°to of the project cost.
