J Q -/ I AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS AT EACH CLASSIFICATION IN THE POLICE DEPARTMENT, RECLASSIFYING ONE POLICE OFFICER POSITION INTO ONE CORPORAL/DETECTIVE POSITION BY CREATING ONE ADDITIONAL CORPORAL/DETECTIVE POSITION AND DELETING ONE POLICE OFFICER POSITION, PROVIDING A STATEMENT OF PURPOSE AND INTENT FOR THE ADOPTION OF THIS ORDINANCE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Police Chief has requested the City Council to readjust and thereafter specify the total number of authorized civil service positions at each classification in the Police Department for the remainder of the 1996-1997 Fiscal Year; and WHEREAS, the City's most recent ordinance concerning the authorized and budgeted positions for the Police Department adjusted the Department's civil service staffing as follows• Deputy Chiefs 5 Captains 13 Lieutenants 47 Sergeants 122 Corporal/Detectives 178 Police Officers 823 TOTAL 1,188 WHEREAS, the Police Chief now requests the Council to adjust the authorized number of Police Department civil service positions into conformity with the proposed changes as set forth immediately below in order to effect efficient economy of the operations of the Police Department; and WHEREAS, pursuant to Chapter 143.021(a), Texas Local Government Code, the City Council may prescribe and/or adjust the authorized number of positions in each classification (rank) by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That, effective immediately upon the formal adoption of this ordinance, the following positions shall be the only civil service positions authorized .in the City of Fort Worth Police Department for the remainder of the fiscal year 1996-1997 or until modified by subsequent ordinance• Deputy Chiefs 5 Captains 13 Lieutenants 47 Sergeants 122 Corporal/Detectives** 179 Police Officers* 822 TOTAL 1,188 * Deletes one position **Creates one new position SECTION 2 The "Mayor and Council Communication" memorandum which is presented contemporaneously with this ordinance is hereby ex- pressly incorporated herein by reference for further clarification and explanation of the purposes and intent of the City Council in its adoption of this ordinance. In addition, it is expressly stated that this ordinance serves only to adjust the total number of police officer positions and corporal/detective positions. 2 a 4 This ordinance shall not operate to increase or decrease the total authorized number of civil service positions in the Police Department. SECTION 3. This ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior civil service staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinan- ces and such Code provisions are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconsti- tutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. 3 APPROVED AS TO FORM AND LEGALITY d~~ty torney I_ Date • ~ ~ ~ ~~~ ADOPTED • ~p - 1 ~ -'~f EFFECTIVE • Cp ~ ~ ~ -' 9 City of Fort Worth Texas Mayor and Council Communication 06/17/97 G-11918 35CIVIL 1 of 2 SUBJECT ORDINANCE ADJUSTING THE AUTHORIZED CIVIL SERVICE STRENGTH IN THE POLICE DEPARTMENT RECOMMENDATION It is recommended that the City Council adopt the attached ordinance specifying the authorized positions in the Police Department, increasing by one the number of authorized corporal/detective positions and decreasing the number of police officer positions by one DISCUSSION On June 22, 1993, the City Council approved M&C G-10214, which provided for assignment pay to the seven police officers assigned to the Traffic Investigation Unit These officers are required to investigate and prepare cases against individuals charged with traffic related offenses and present them to the District Attorney's Office for prosecution Due to the transition of this Unit to a criminal investigative function, the department began to convert the police officer positions to corporal/detective positions as they became vacant On July 9, 1996, the City Council approved M&C G-1 1513, to convert two of the seven positions to corporal/detectives Currently, there is one police officer vacancy in the Traffic Investigation Unit that the department wishes to fill with acorporal/detective The department`s authorized civil service strength is as follows Deputy Chief 5 Captain 13 Lieutenant 47 Sergeant 122 Corporal/Detective 178 Police Officer 823 Total 1,188 t„, t ~ ~ , > r ' ~ .. ,:, .. #N ~l,t 4 J F i ~ • 5.
