AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
SPECIAL ASSESSMENTS FUND, AWARDED ASSETS IN THE AMOUNT OF $1,050,410.00 FROM
AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE INSTALLATION OF COMMUNITY
FACILITIES AT NORTH RIVERSIDE DRIVE EXTENSION AT FOSSIL CREEK, PROVIDING FOR A
SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES
AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS.
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1996-97 and in the Budget of
the City Manager, there shall also be increased estimated receipts and appropriations in the Special Assessments Fund, in the
amount of $1,050,410.00 from available funds for the purpose of funding the installation of community facilities at north
Riverside Drive extension at Fossil Creek.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a
court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or
parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 12629 and all other ordinances and appropriations amending the
same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and
appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly
repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained.

RECOMMENDATION•
It is recommended that the City Council
Adopt the attached appropriation ordinance increasing estimated receipts and
appropriations by $1,050,410 in the Special Assessments :Fund and ~ in the New
Development Fund from available funds, and
2 Authorize the transfer of 51,050,410 from the Special Assessment Fund. to the New
Development Fund~;_ and
3 Authorize the City Manager to execute a Community Facilities Agreement with the
developer, Hunt Resources, for the installation of comm{~nity facilities for North Riverside
Drive Extension at Fossil Creek _
DISCUSSION
Hunt Resources, Inc ,the developer of North Riverside Drive Extension at Fossil Creek has
executed a;proposed contract'for community facilities to construct adouble-26' wide roadway
of a future double `3F=~-wide~arterial grade roadway with left turn lanes and median. openings ~at
approved;locations along with all necessary storm drainage systems to properly~-•drainathe street,
including an enclosed outfall from the northern end of this roadway~ao~ Big FossiF Creek. This
development is located in COUNCIL DISTRICT 4 ,

The developer is required to~deposit cash in the amount of 5158,100 to secure the cost of water
utility .improvements- The balance, of improvement cost will be secured through the filing ,of a
Mechanical's lien in the amount of 51,050,410 in lieu of a Developer Bond. ~or Cash deposit, to
be paid in siz equal .payment with first payment due. 30 days after completion of construction
and five annual payments at 8% interest of outstanding balance Developer has the option of
paying =off its ,obligation. early; obligation for each 1 /6 paymenfi~ received <of the, lien will be
released Balance of the lien in its entirety will be released upon final payment The construction
of approximately 5,950 linear feet of sidewalks are required for this project
