HomeMy WebLinkAboutOrdinance 13146~~ ~~ ORDINANCE NO 3 ~ AN ORDINANCE AMENDING SECTIONS 35-56(b), 35-56(g), and 35-56(h) OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY REVISING AND ADDING CERTAIN RATES AND CHARGES, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH, PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. BE IT OTtDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH. SECTION 1 That Section 35-56(b) of Chapter 35 of the Code of the Crty of Fort Worth (1986), as amended, is hereby amended to be and read as follows RAW WATER SERVICE All use per month $0 6276 per 1,000 gallons inside Tarrant County Water Control and Improvement District No 1 All use per month $0 6989 per 1,000 gallons outside Tarrant County Water Control and Improvement District No 1 SECTION 2. That Section 35-56(g) of Chapter 35 of the Code of the Crty of Fort Worth (1986), as amended, is hereby amended to be and read as follows RATE FOR WHOLESALE WATER SERVICE Volume ($/1,000 gallons)* $0.3855 Maximum Day ($/MGD excess) $82,950 Maximum Hour ($/MGD excess) $21,215 Customer ($/Meter/Month) $ 25 00 *plus raw water cost ~~ SECTION 3 That Section 35-56(h) of Chapter 35 of the Code of the City of Fort Worth (1986) as amended, is hereby amended to be and read as follows. RATE FOR WHOLESALE WASTEWATER SERVICE Volume (per 1,000 gallons) $0.5820 BOD ($/pound) $0 1683 TSS ($/pound) $0 1753 Customer ($/month) $ 75 00 SECTION 4. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the Crty of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinance and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconshtuhonal phrase, clause, sentence, paragraph or section. 0 ,s SECTION 6.
