AN ORDINANCE VACATING, ABANDONING, CLOSING AND
EXTINGUISHING 2.5 FEET OF AN EXISTING 7.5 FOOT WIDE UTILITY
EASEMENT, GARDEN SPRINGS, PHASE I, TO THE CITY OF FORT
WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID
LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the 2 5 foot wide section of an existing 7.5 foot wide utility easement
located on Block 1, Lot 19, Garden Springs, Phase I, as recorded in Cabinet A, Slide
2620, Plat Records of Tarrant County, Texas, and as more specifically described in
Exhibit A attached hereto and incorporated herein by reference be and the same is
vacated, abandoned and permanently closed and extinguished
SECTION 2.
That the fee to the land in the above described vacated utility easement is
hereby released and shall revert to the adjacent owner as provided by law
SECTION 3
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed
SECTION 4
That this ordinance shall take effect and be in full force and effect from and after
the date of its passage, and it is so ordained

RECOMMENDATION
It is recommended that the City Council adopt the attached Ordinance vacating a 2 5-foot wide
section of an existing 7 5-foot wide utility easement located on Block 1, Lot 19, Garden Springs,
Phase I, as recorded in Cabinet A, Slide 2620, Plat Records, Tarrant County, Texas
DISCUSSION
Choice Homes, owner of the subject property, has requested that the City partially vacate the
above described utility easement in order to eliminate an existing building encroachment The
subject easement, acquired by dedication, contains no utility facilities Reviewing City
departments and private utility companies have raised no objections to this request A replat is
not required for this request
This request is located in COUNCIL DISTRICT 6
FISCAL INFORMATION/CERTIFICATION
The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the
interest of the City of Fort Worth in this request
