AN ORDINANCE INCREASING THE ESTIMATED RECEIl'TS AND APPROPRIATIONS IN THE
CAPITAL PROJECTS RESERVE FUND IN THE AMOUNT OF $398,669 00 FROM AVAILABLE
FUNDS FOR THE PURPOSE OF FUNDING TH$ REFURBISHMENT OF ONE LADDER TRUCK
FROM SIMON LTI, INC , PROVIDING FORA SEVERABILITY CLAUSE, MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR
ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1996-97 and in the Budget
of the City Manager, there shall also be increased estimated receipts and appropriations in Capital Projects Reserve Fund
in the amount of $398,669 00 from available funds for the purpose of funding the refurbishment of one ladder truck from
Simon LTI, Inc.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by
a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions,
sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and
effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 12629 and all other ordinances and appropriations amending
the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances
and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby
expressly repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained.

REFURBISHMENT OF ONE LADDER TRUCK FROM SIMON LTI, INC FOR THE FIRE

RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached supplemental appropriation ordinance increasing estimated receipts and
appropriations in the Capital Projects Reserve Fund by 5398,669 from available funds, and
2 Authorize the transfer of 5398,669 from the Capital Projects Reserve Fund fio the General
Fund, and
3 Adopt the attached supplemental appropriation ordinance increasing estimated receipts and
appropriations in the General Fund by 5398,669 from available funds, and
4 Authorize the sole source purchase of refurbishment to one ladder truck from Simon LTI,
Inc for an amount not to exceed 5398,669, including a 7 percent contingency charge and
transportation to and from the factory
DISCUSSION
The Fire Department recently placed Truck 2 out of service after discovering that metal fatigue
in strategic components resulted in the truck becoming unsafe to operate Truck 2, a 1982 LTI
100' ladder tower operated out of Fire Station 2, is a primary response apparatus for highrise
incidents in and around the downtown area and is one of only two ladder tower apparatus
covering the entire city Wear and tear from operating this unit over the past 14 years has
caused metal fatigue in the outrigger tubes to the point that the tubes have cracked The tubes
are extended out from the sides of the apparatus to stabilize the unit when the ladder is extended
up A failure of the tubes with the ladder extended will not only result in a loss of the truck, but
quite likely serious injury or loss of life to those on the ladder and around the truck during the
failure
The cost to replace this unit is 5750,000 Simon LTI, Inc was the original manufacturer of the
unit On November 23, 1992, a sole source purchase agreement was authorized with Simon LTI,
Inc to furnish parts This agreement has been renewed each year Due to the sole source
availability, for parts,?other vendors would not be able to make repairs and warranty the work
performed for aerial ladder certification Product liability requirements mandate that certification
of aerial ladders be-performed to assure all mechanisms work within the manufacturer's original
tolerance specification Based on these facts, competitive bids were not solicited The

manufacturer provided a written estimate of 5398,669 to rebuild the unit This price includes
rebuilding or replacing all the major components and installing a new cab and chassis The
completed unit would carry a new VIN number and title, and would have a new truck warranty
It is estimated that factory refurbishing will extend the useful life of this unit by at least ten
years
FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that upon adoption of the attached supplemental
appropriation ordinance, funds required for this expenditure will be available in the current
operating budget The cash balance in the Capital Projects Reserve Fund, after this transfer will
be 57,226,355
