HomeMy WebLinkAboutOrdinance 13250ORDINANCE NO. ! ~a.5o AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A TWO FOOT (2') WIDE UTILITY EASEMENT, TO THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS• SECTION 1. THAT the easement vacating the south 2 feet of a utility easement containing 142 7 square feet in area as recorded in Cabinet A, Slide 1303, Plat Records of Tarrant County, Texas, and as more specifically described in Exhibit A .attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished SECTION 2. It is recommended that the City Council adopt the attached Ordinance vacating the south 2 feet of a utility easement contauung 142 7 square feet in area as recorded m Cabinet A, Slide 1303 DISCUSSION. Mr Bill Sterback, owner of the subject property, has requested that the City vacate the above described utility easement to elinunate an encroachment by a swimming pool. The portion of the subject easement to be vacated, acquued by dedication, contains no urility facilities. Reviewing City departments and private utility companies have raised no obJechons to this request. A replat is not required for this request. This request is located m COUNCIL DISTRICT 3 FISCAL INFORMATION/CERTIFICATION. The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the interest of the City of Fort Worth m this request.
