HomeMy WebLinkAboutOrdinance 12954t .~ Ordinance No. Of % ~'T AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $10,994,000 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM ($7,815,000 00), THE HOME INVESTMENT PARTNERSHIP PROGRAM ($2,390,000), THE EMERGENCY SHELTER GRANT PROGRAM ($207,000 00), AND THE HOUSING OPPORTUNITIES FOR PEOPLE WITH AIDS PRGRAM ($582,000 00) THROUGH A GRANT FROM THE U S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, PROVIDING FOR A SEVERABII,ITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That m addition to those amounts allocated to the vanous City departments for the Fiscal Year 1996-97 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropnations in the Grants Fund in the amount of $10,994,000 00 from available funds for the purpose of funding the Commumty Development Block Grant Program ($7,815,000 00), the Home Investment Partnership Program ($2,390,000), the Emergency Shelter Grant Program ($207,000 00), and the Housing Opportumties for People with AIDS Program ($582,000 00) through a grant from the U S. Department of Housing and Urban Development. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent Iunsdiction, such decision, opuuon or Iudgement shall in no way unpa~r the remauung portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 12629 and all other ordinances and appropnations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropnations, m which instance said conflicting provisions of said pnor ordinances and appropnations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY (...J Assista t ity Attorney 3~r~~~~- Date ~J ~~ Adopted Effective City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUNffiER LOG NAME PAGE 03/18/97 G-11819 13HUD 1 of 2 SUBJECT CONSOLIDATED ACTION PLAN (CAP) GRANT APPLICATION (CDBG, ESG, HOME AND HOPWA GRANTS) FOR SUBMISSION TO THE U S DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) RECOMMENDATION It is recommended that the City Council 1 Approve the Oity's Consolidated Action Plan (CAP) Grant Application for submission to the U S Department of Housing and Urban Development (HUD) The CAP grants consist of the Community Development Block Grant (CDBG), HOME Investment Partnerships Program, Emergency Shelter Grant Program (ESG) and Housing Opportunities for Persons With AIDS (HOPWA) grants, and 2 Adopt an appropriations ordinance increasing estimated receipts and appropriations in the Grants Fund from available funds in an amount up to 57,815,000 for CDBG funds, 52,390,000 for HOME funds, 5207,000 for ESG funds and 5582,000 for HOPWA funds, and 3 Authorize the use of 543,937 50 from the Radisson Parking Garage account as the City's cash match, and transfer 543,937 50 from the Radisson Parking Garage revenue account to the 1997 HOME Program account, and 4 Authorize the use of 560,000 in City-owned properties, at appraised value, as in-kind match for the 1997 HOME Program An increase above this amount in in-kind properties will reduce the City's cash match requirements, and 5 Authorize the use of 5150,000 resulting from the forbearance of taxes as in-kind match for the 1997 HOME Program An increase above this amount in the forbearance of taxes will reduce the City's cash match requirements, and 6 Apply indirect cost rate as applicable for the Grants Fund in accordance with the City's Administrative Regulation 3-15 DISCUSSION In 1994, HUD put forth a new policy requiring a consolidated plan in regard to housing and comm~nity;;development activities carried out by local jurisdictions The Consolidated Plan is a documerit-vv~iic.hmcombines application and planning processes for the four (4) major HUD funding sources i~'CDBG, HOME, ESGP, and HOPWA On April 17, 1995, the City of Fort Worth submitted its Consolidated Plan to HUD It included a Citizen Participation Plan, Needs Analysis, Five-Year Strategic Plan, and an Action Plan detailing the first year's funding use of activities ~.
