HomeMy WebLinkAboutOrdinance 12864Ordinance No.~_~- ~y - ~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL FUND IN THE AMOUNT OF $20,000 00 FROM INCREASED AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A PROFESSIONAL SERVICES AGREEMENT TO KIM MARTIN AND COMPANY FOR PROFESSIONAL MARKET ANALYSIS/REAL ESTATE SERVICES RELATING TO COMMERCIAL AND INDUSTRIAL ZONED CITY OWNED PROPERTY AND CITY OWNED LAND AT LAKE WORTH; PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1996-97 and m the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Fund in the amount of $20,000 00 from mcreased available funds for the purpose of funding a professional services agreement to Kin Martin and Company for professional market analysis/real estate services relating to commercial and industrial zoned city owned property and city owned land at Lake Worth. SECTION 2. Should any portion, section or part of a section of this ordmance be declared invalid, inoperative or void for any reason by a court of competent ~unsdiction, such decision, opiuon or judgement shall m no way impair the remaining portions, sections, or parts of sections of this ordmance, wlmch said remaiung provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 12629 and all other ordinances and appropriations amending the same except m those instances where the provisions of this ordinance are m duect conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 Tlus ordmance shall take effect and be m full force and effect and after the date of rts passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY ~~ Assistant Attorney Date ~-~~' 9~ Adopted Effective City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 02/1 1 /97 **C-5893 30KIM 1 of 2 SUBJECT ADOPTION OF SUPPLEMENTAL APPROPRIATIONS ORDINANCE AND AWARD OF PROFESSIONAL SERVICES AGREEMENT TO KIM MARTIN AND COMPANY FOR PROFESSIONAL MARKET ANALYSIS/REAL ESTATE SERVICES RELATING TO COMMERCIAL AND INDUSTRIAL ZONED CITY OWNED PROPERTY AND CITY OWNED LAND AT LAKE WORTH RECOMMENDATION It is recommended that the City Council 1 Adopt the attached supplemental appropriations ordinance increasing estimated receipts and appropriations In the General Fund by 520,000 available funds from the sale of surplus properties, and 2 Authorize the City Manager to execute an annual Professional Services agreement with Kim Martin and Company for a fee not to exceed 540,000 to prepare a market analysis for commercial and industrial zoned surplus properties owned by the City of Fort Worth and City owned land at Lake Worth DISCUSSION On December 5, 1995, City Council approved the award of a professional services agreement with the real estate services firm of Kim Martin and Company The agreement provided fior the preparation of a market analysis of the inventory of City-owned surplus property Kim Martin and Company have performed well during the past year and provided the City with a product which has proven to be very useful in our marketing and disposal of surplus properties The Department of Engineering is proceeding with the systematic disposal of surplus property acquired through Sheriff Sales and in addition is about to implement the phased sale of city-owned Lake Worth leases Kim Martin and Company have agreed to provide market analysis services for City owned properties The market analysis services will include • Determination of fair market value, • Determination of each property's highest and best use, • Recommendation fior potential zoning changes, • Marketing strategies for each property or groups of properties, • Packaging or grouping of specific properties to maximize the sales potential for the City Printed on Recycled Paper City of Fort Worth, Teaca~ Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 02/1 1 /97 **C-15893 30KIM 2 of 2 svsJECT ADOPTION OF SUPPLEMENTAL APPROPRIATIONS ORDINANCE AND AWARD OF PROFESSIONAL SERVICES AGREEMENT TO KIM MARTIN AND COMPANY FOR PROFESSIONAL MARKET ANALYSIS/REAL ESTATE SERVICES RELATING TO COMMERCIAL AND INDUSTRIAL ZONED CITY OWNED PROPERTY AND CITY OWNED LAND AT LAKE WORTH Based upon their demonstrated understanding of the Clty's needs, proposed scope of services and experience, Kim Martln and Company are one of two consultants recommended to complete projects on an as needed basis for a fee not to exceed 540,000 Half the fee is to be funded out of the General Fund and the remainder from the Lake Worth Trust Fund Staff considers this fee to be reasonable for the scope of services to be provided Kim Martin and Company is in compliance with the City's M/WBE Policy by committing to 15 % M/WBE participation The City's goal on this project is 15 ,;FISCAL INFORMATION/CERTIFICATION The Director of Fiscal Services certifies that upon the adoption of the attached supplemental appropriations ordinance, funds required for this agreement will be available in the current operating budget, as appropriated, of the General Fund Additional funds required are currently available in the Lake Worth Trust Fund MGf Submitted for City Manager's FUND ACCOUNT CENTER AMOUNT CITY SECRETARY Office by: (to) 1)GGO1 444563 0134010 '20 000 00 APP ROVED Mike Groomer 6140 1)GG01 539120 0134010 20 000 00 lj' (~ 1 ®UN ~ ~~ Originating Department Head: 1 V j FE A.
