HomeMy WebLinkAboutOrdinance 13071~~ :si?~ ~ ? 22 ORDINANCE NO ~~ AN ORDINANCE AMENDING CHAPTER 29 OF THE CODE OF THE CITY OF FORT WORTH, "SIGNS" BY RENAMING AND AMENDING SEC. 29-6, TO REQUIRE THAT THE SIGN REGISTRATION NUMBER AND THE NAME OF THE OWNER BE PLACED ON ALL OFF-PREMISE SIGNS IN LETTERS AND NUMBERS AT LEAST FIVE (5) INCHES HIGH; PROVIDING THAT THIS ORDINANCE WILL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, approximately 1,000 off-premise outdoor advertising signs are located in the City of Fort Worth, WHEREAS, on April 15, 1997 the City of Fort Worth enacted Ordinance No 12971 requiring the registration of off-premise outdoor advertising signs on or before October 1, 1997, WHEREAS, all off-premise signs registered with the City of Fort Worth will be assigned a registration number by the Department of Development; WHEREAS, Sec. 29-6 of the Code of the City of Fort Worth currently requires that athree-inch by five-inch marker identifying the party that owns or controls the sign be placed on all on-premise and off-premise signs that are not exempt from the Sign Code pursuant to Sec. 29-5, WHEREAS, it is advisable to amend Sec. 29-6 to require that off-premise signs also show the registration number assigned by the City of Fort Worth and to require that the registration number and the name of the owner be shown in letters at least five (5) inches high, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 The Sign Code of the City of Fort Worth, Chapter 29 of the Code of the City of Fort Worth, is amended by renaming Sec. 29-6, which is currently titled "Markers -1- identifying sign owners", and amending Sec. 29-6 to require that the name of the owner and the registration number, if applicable, be shown on all off-premise signs in letters and numbers at least five (5) inches high, as follows. Sec. 29-6. Markers identifying sign owners and registration numbers . (a) On-premise signs There shall be placed and maintained in plain view on each detached on-premise sign not specifically exempt herein athree-inch by five-inch marker that identifies the person, firm or corporation owning or controlling the sign The marker shall be placed on the detached sign not to exceed eleven (11 } feet above ground level (b) Off-premise signs All off-premise signs shall display a placard on the lower portion of the message or edging board that identifies the person, firm or corporation owning or controlling the sign Those signs required to be registered in accordance with Sec. 29-31 shall also display the sign registration number in the same location The placard shall be placed in a location with letters and numbers that are visible from the street and are at least five (5) inches high SECTION 2 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared -2- . unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section SECTION 4. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Five Hundred Dollars ($500 00) for each offense Each day that a violation is permitted to exist shall constitute a separate offense SECTION 5 All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of the Code of the City of Fort Worth which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts SECTION 6. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the -3- t official newspaper of the City of Fort Worth, Texas, as authorized by Section 52 013, Texas Local Government Code SECTION 7 This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained APPROVED AS TO FORM AND LEGALITY. ssistant City Attorney ---_..
