HomeMy WebLinkAboutOrdinance 13279 ORDINANCE NO. ~~_ AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING PARTIAL STREET RIGHT-OF-WAY, CHAMBERLIN ARLINGTON HEIGHTS ADDITION, TO THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT the following 12 5 foot wide strip of right-of-way dedicated for Collinwood Avenue located on the north side- of Collinwood Avenue extending westward 200 23 feet in length from the west line of Prevost Street, abutting Lots 33 thru 40, Block 49, Chamberlin Arlington Heights, First Filing as recorded in Volume 63, Page 21, Plat Records, Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished SECTION 2 That the fee to the land in the above described partial street right-of-way is hereby released and shall revert to the adjacent owner as provided by law SECTION 3 That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. Said right-of-way abuts Lots 33 thru 40, Block 49, Chamberlin Arlington Heights, First Filing as recorded in Volume 63, Page 21, Plat Records, Tarrant County, Texas. DISCUSSION Klabzuba Properties, owner of the subject property, has requested that the City vacate the above described street right-of-way to facilitate the development of new residences on the adjoining property The subject right-of-way, acquired by dedication, contains no utilities. Reviewing City departments and private utility companies have raised no objections to this request. A satisfactory replat has been submitted for this request (FS-97-133). This request was recommended for approval by the City Plan Commission at their meeting of September 24, 1997 This request is located in COUNCIL DISTRICT 7 FISCAL INFORMATION/CERTIFICATION The Land Agent for the City of Fort Worth has determined that a $11,013.20 fee satisfies the interest of the City of Fort Worth in this request.
