AN ORDINANCE AMENDING THE CODE OF THE CITY OF
FORT WORTH (1986), AS AMENDED, BY THE AMENDMENT OF
CHAPTER 7, "BUILDINGS," ARTICLE IV, "MINIMUM
BUILDING STANDARDS CODE," DIVISION 2,
"ADMINISTRATION," SECTIONS 7-77 (E) And (H) "BUILDING
STANDARDS COMMISSION" PROVIDING FOR THE BUILDING
STANDARDS COMMISSION TO BE ABOLISHED EFFECTIVE
SEPTEMBER 30,1997, AND PROVIDING THAT THE TWO YEAR
TERMS OF COMMISSION MEMBERS SHALL EXPIRE ON
SEPTEMBER 30 OF EVEN-NUMBERED YEARS FOR EVEN-
NUMBERED PLACES AND SEPTEMBER 30 OF ODD-
NUMBERED YEARS FOR ODD-NUMBERED PLACES;
PROVIDING THAT THIS ORDINANCE IS CUMULATIVE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
SAVINGS CLAUSE;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth finds that the present Building
Standards Commission members should serve on the Building Standards Commission
through September 30, 1997,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH TEXAS:
SECTION 1.
The Code of the City of Fort Worth, Texas (1986), as amended, is amended by the
amendment of Chapter 7, "Buildings," by the amendment of Article IV, "Minimum
Building Standards Code," Division 2 "Administration," Sections 7-77 (e) and (h)
"Building Standards Commission," so that hereafter Section 7-77 (e) and (h) shall read as
follows.
(e) Members of the Commission in the odd-numbered places shall serve terms
expiring September 30 of odd numbered years. The first term of such
members shall expire September 30, 1999 Members of the Commission in
the even-numbered places shall serve terms expiring September 30 of the
even-numbered years. The first term of such members shall expire
September 30, 1998. Thus, members meven-numbered places shall only
serve one year (October 1, 1997 to September 30, 1998) for their imtial term, `
and two years for each term thereafter
(h) The Building Standards Commission which was created by previous
ordinance and which is in place on the effective date of this Article shall
follow all newly established procedures and standards on their effective date.
However, the Building Standards Commission created by previous ordinance
shall not be abolished until September 30, 1997 New Commission members
shall be named on September 30, 1997, and the new members shall be sworn
into office as soon as possible thereafter
SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the Code
of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this
ordinance are m direct conflict with the provisions of such ordinances and such Code, m
which event conflicting provisions of such ordinances and such Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph, or section of this ordinance shall be declared
__ ~-unconstitutional by the valid judgment or decree of any court of competent ~unsdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation m this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 4.
All nghts and remedies of the City of Fort Worth, Texas, are expressly saved as to
any and all violations of the provisions of the ordinance amended m Section 1, which
have accrued at the time of the effective date of this ordinance and, as to such accrued
violations and all pending litigation, both civil and cnminal, whether pending in court or
not, under such ordinances, same shall not be affected by this ordinance but may be
prosecuted until final disposition by the courts.
SECTION 5.
This ordinance shall be in full force and effect after its passage and publication as
required by law

SUBJECT AMENDMENT OF THE CODE OF THE CITY OF FORT WORTH, CHAPTER 7, RELATING
TO BUILDING STANDARDS COMMISSION APPOINTMENTS
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance revising the Code of the
City of Fort Worth, relating to appointment of Building Standards Commission members to enable
them to continue to serve on the Commission through September 30, 1997
DISCUSSION
On March 25, 1997 (M&C G-11833), the City Council approved an ordinance revising the
Minimum Building Standards Code Sections 7-77 (e) and (h) abolish the current Building
Standards Commission effective April 30, 1997, establish the new Commission effective that
date, and provide that new Commission members be sworn into office "as soon as possible
thereafter "
On April 1, 1997, the City Council Inter and Intra Governmental Committee was asked to
consider options that are available to the City Council in appointing members to the Building
Standards Commission such that the "new" Commission can be functioning in May The
direction of the Inter and Intra Governmental Committee was for staff to query each Commission
member to determine their willingness to continue to serve on the Building Standards
Commission through September 30, 1997 and to revise the current ordinance to enable them to
do that
Attached is information regarding current Building Standards Commission members and their
service on the Commission Those members have been contacted by staff and all are willing to
continue to serve through September 30, 1997
