AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS NOMINATING AN AREA AS AN ENTERPRISE ZONE
PURSUANT TO THE TEXAS ENTERPRISE ZONE ACT (TEXAS
GOVERNMENT CODE, CHAPTER 2303); PROVIDING TAX
INCENTIVES; DESIGNATING AN AUTHORIZED REPRESENTATIVE TO
ACT IN ALL MATTERS PERTAINING TO THE NOMINATION AND
DESIGNATION OF THE AREA DESCRIBED HEREIN AS AN
ENTERPRISE ZONE AND REINVESTMENT ZONE (TEXAS TAX CODE,
CHAPTER 312); AND FURTHER DESIGNATING A LIAISON TO ACT
ON ALL MATTERS PERTAINING TO THE ENTERPRISE ZONE ACT
ONCE DESIGNATED BY THE TEXAS DEPARTMENT OF COMMERCE.
WHEREAS, the City Council of the City of Fort Worth, Texas
desires to create the proper economic and social environment to
induce the investment of private resources in productive business
enterprises located in severely distressed areas of the city and
to provide employment to residents of such area;
WHEREAS, certain conditions exist in such area which represent a
threat to the health, safety, and welfare of the people of such
area; and
WHEREAS, it is necessary and in the best interest of the City to
nominate such area as an enterprise zone pursuant to the Texas
Enterprise Zone Act {Texas Government Code, Chapter 2303, the
"Act") ; and
WHEREAS, such area meets the criteria for designation as an
enterprise zone as set forth in the act
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS
Section 1. That the City hereby nominates the area set forth and
attached hereto as Exhibit A.

Section 2. That the City Council finds the zone area meets the
qualifications of the Act.
Section 3. That the City Council will provide certain tax
incentives applicable to business enterprises in the zone on a
case by case basis which are not applicable throughout the City
as follows:
The City shall refund to any qualified business meeting
minimum standards and located in such enterprise zone
the amount of tax paid under the Municipal Sales and
Use Tax Act (Texas Tax Code, Chapter 321) by the
business for rehabilitation, reconstruction or
construction costs of real property.
Other incentives that may be negotiated in the proposed
enterprise zone on a case by case basis are as follows:
A reduced schedule of development fees to enterprise
zone businesses meeting minimum standards
Accelerated zoning and permit procedures Enterprise
zone businesses meeting minimum standards will be
processed upon receipt, before non-enterprise zone
businesses already in hand.
Transfer of city owned surplus land at below market
prices for the public purpose of economic development.
The ability to purchase city-owned land shall be based
upon the extent to which the business receiving the
property creates jobs for qualified employees, in
accordance with the attached Exhibit B

Section 4. That the area described in this ordinance is
designated as an enterprise zone, and a reinvestment zone,
subject to the approval of the Texas Department of Commerce.
Section 5. That the City Council directs and designates its City
Manager as the City's authorized representative to act in all
matters pertaining to the nomination and designation of the area
described herein as an enterprise zone, and a reinvestment zone.
Section 6. That the City Council further directs and designates
the City's economic development coordinator as liaison for
communication with the Department to oversee zone activities and
communications with qualified businesses
Section 7 That a public hearing to consider this ordinance was
held by the City on February 6, 1997.
Section 8. That this ordinance shall take effect from and after
its passage as the law and charter in such case provides.
SECTION 2.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas
(1986), as amended, except where the provisions of this ordinance
are in direct conflict with the provisions of such ordinances and
such Code, in which event conflicting provisions of such
ordinances and such Code are hereby repealed.

SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section.

construction on a business within the target area

- on a negotiated basis, accelerated zoning and permit procedures. Enterprise zone
businesses meeting minimum standards will be processed upon receipt, before non-
enterprise zone businesses.

RECOMMENDATION.
It is recommended that the City Council
1 Adopt the attached ordinance nominating as an enterprise zone the area set forth and
attached to said ordinance as Exhibit A, and
2 Find that the zone area meets the requirements and criteria of the Texas Enterprise Zone
Act, and
3. Find that a public hearing to consider this ordinance was held by the City on February 6,
1997, and
4 Direct and designate its City Manager as the City's authorized representative to act in all
matters pertaining to the nomination and designation of the area described herein as an
enterprise zone, and a reinvestment zone, and
5 Direct and designate the City's economic development coordinator as liaison for
communication with the Department of Commerce to oversee zone activities and
communications with qualified businesses, and
6 Authorize the City Manager to submit the appropriate application to the Texas Department
of Commerce for designation of the North Enterprise Zone
DISCUSSION.
Enterprise Zones in the City of Fort Worth expired in September, 1995 Applications for new
zones would again provide this economic development tool to the City of Fort Worth This action
would establish the North Fort Worth Enterprise Zone The proposed zone was presented to the
Expanding Economic Opportunities Committee of the City Council on January 15, 1997 Public
hearings were held on February 6, 1997 to receive public input on the proposed zone boundaries
and incentives After compiling all information and meeting all State requirements, the final
recommendations are to be submitted as part of the enterprise zone application to Texas
Department of Commerce

The incentives to be offered by the City in the zone have been broken into two categories The
first category is the non-target area incentive which will apply to those areas on the enterprise
zone that fail outside the City's designated "central city" areas This incentive includes

economic development The ability to purchase city-owned land shall be based upon
the extent to which the business receiving the property creates jobs for qualified
employees
The second category is the target area incentives which will apply to those areas of the
enterprise zone that fall inside the City's designated "central city" areas These incentives
