HomeMy WebLinkAboutOrdinance 12898 Ordinance No. / AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL FUND IN THE AMOUNT OF $150,935 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH TEXAS MUNICIPAL SERVICES, INC., FOR MUNICIPAL COURT COLLECTION SERVICES, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1996-97 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Fund in the amount of $150,935 00 from available funds for the purpose of funding the a contract with Texas Municipal Services Inc., for Municipal Court collection services. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shalt be cumulative of Ordinance No. 12629 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated receipts and appropriations from available funds in the General Fund by 5150,935 for the purpose of funding contract payments to Texas Municipal Services, Inc ,for Municipal Court collection services DISCUSSION. Municipal Court contractual collection services for FY 1996-97 were approved through M&C C- 15602 on August 20, 1996 The contract, awarded to Texas Municipal Services, Inc , (TMS), stipulates compensation for collection services to be based on specified percentages of actual monies collected, less any fees and court costs required or permitted by state law Approximately 5221,912 was budgeted for current year collection service obligations Year-to-date collection service expenditures at 4 112 months into current year operations total 5139,508 which is approximately 63°l0 of budgeted allocations Based on collection activity this fiscal year expenditures are expected to exceed initial projections and will require an additional 5150,935 to meet total contractual obligations for the year With expenses based on a percentage of actual monies collected, the supplemental appropriation request will be offset by collection service revenues FISCAL INFORMATION/CERTIFICATION.
