HomeMy WebLinkAboutOrdinance 12801ORDINANCE NO U AN ORDINANCE PROVIDING FOR THE CHANGING OF A PORTION OF THE CORPORATE BOUNDARIES OF THE CITY OF FORT WORTH AND THE CITY OF BURLESON BY DISANNEXING AND DISCONTINUING FROM THE CORPORATE LIMITS OF THE CITY OF FORT WORTH A 3 584 ACRE TRACT OF LAND SITUATED IN THE SARAH GRAY SURVEY, ABSTRACT NUMBER 558, CITIES OF FORT WORTH AND BURLESON, TARRANT COUNTY, TEXAS, AND BEING COMPRISED OF A PORTION OF TRACT "B" AND ALL OF TRACT "A" AS DESCRIBED BY DEED TO J C PACE AND COMPANY, RECORDED IN VOLUME 6709, PAGE 691 OF THE DEED RECORDS OF TARRANT COUNTY, TEXAS, AND A PORTION OF A TRACT OF LAND CONVEYED TO J C PACE AND COMPANY, RECORDED IN VOLUME 8852, PAGE 1063 OF THE DEED RECORDS OF TARRANT COUNTY, PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT, PROVIDING FOR SEVERABILITY, AND NAMING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That, in accordance with and subject to that certain Joint Resolution and Agreement between the City of Fort Worth and the City of Burleson, a copy of which is attached hereto and expressly made a part hereof, the following described land within the corporate limits of the City of Fort Worth is hereby disannexed and discontinued as a .part of the City of Fort Worth, Texas, said land being described as follows Being that certain tract of land situated in the Sarah Gray Survey, Abstract Number 558, Cities of Fort Worth and Burleson, Tarrant County, Texas and being comprised of a portion of Tract "B" and all of Tract "A" as described by Deed to J C Pace & Company, recorded. in Volume 6709, Page 691 of the Deed Records Tarrant County, Texas and a portion of that tract of land conveyed to J C Pace & Company, recorded in Volume 8852 Page 1063 of said Deed Records and being more particularly described by metes and bounds as follows Beginning at the intersection of the southerly right-of-way of Boone Road (a called 50 foot right-of-way) and the westerly of Stone Road (a 90 foot right-of-way), Thence N 89° 39' 53" W, 161 63 feet with said southerly right-of-way; Thence N 00° 08' 17" E, 660 80 feet, departing said north right-of- way, to the beginning of anon-tangent curve to the left.. Thence with said non-tangent curve to the left, an arc distance of 300 80 feet, through a central angle of 16° 58' S1 ", having a radius of 1014 93 feet, the long chord of which bears N 52° 05' 24" W, 299 70 feet, to the southerly right-of-way of Alsbury Boulevard (a variable width right-of-way), Thence S 89° 54' 22" E, 398 53 feet, with said southerly right-of- way, to a 5/8 inch iron rod with plastic cap stamped "Carter & Burgess", found in the west right-of-way line of said Stone Road, Thence S 00° 08' 17" W, 845.23 feet, with said west right-of-way, to the point of beginning and containing 156,100 square feet or 3 584 acres of land more or less Said 3 584 acre tract is depicted in detail on the map attached hereto, marked Exhibit "A" and incorporated herein for all purposes SECTION 2 That the above described disannexation and discontinuation of land from the corporate limits of the City of Fort Worth is for the express purpose of changing the boundaries of the two cities pursuant to the provisions of Section 43 031 of the Texas Local Government Code SECTION 3 That this ordinance shall and does amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict, this ordinance shall be, and the same is hereby made cumulative SECTION 4 It is hereby declared to be the intent of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional phrase, clause, sentence, paragraph or section SECTION 5 That this ordinance shall be in full force and effect from and after the date of its passage by the City Council, and it is so ordained APPROVED AS TO FORM AND LEGALITY 4 Cil/ William W Wood Deputy City Attorney r Date f.~ -'-t ~-'~`L Adopted ~~ ! -- I Effective f ~ - l 7~ l~ ~ ~I CORPORATE BOUNDARY CHANGE - CITY OF FORT WORTH PROJECT DISANNEXATION OF 3.584 AC. It is recommended that the City Council adopt the attached ordinance providing for the changing of a portion of the corporate boundaries of the City of Fort Worth and the City of Burleson by disannexing and discontinuing from the corporate limits of the City of Fort Worth a 3 584 tract of land located in the Sarah Gray Survey, Abstract No 558, so that said area thereafter may be annexed by the City of Burleson DISCUSSION. On November 5, 1996, the City Council, pursuant to M&C G-11669, adopted a Joint Resolution and Agreement between the City of Fort Worth and the City of Burleson, providing for the changing of a portion of the corporate boundaries of the two cities Specifically, the City of Fort Worth agreed to disannex from its corporate limits a 3 584 acre tract of land located in the Sarah Gray Survey, Abstract No 558, Cities of Fort Worth and Burleson, Tarrant County, Texas, and being comprised of a portion of Tract "B" and all of Tract "A" as described by deed to J C Pace and Company, recorded in Volume 6709, Page 691 of the Deed Records of Tarrant County, Texas, and a portion of a tract of land conveyed to J C Pace and Company, recorded in Volume 8852, Page 1063 of the Deed Records of Tarrant County The described tract is located immediately west of Spinks Airport, as shown on Exhibit "A" of the proposed ordinance Following the disannexation, the 3 584 acre tract will be annexed by the City of Burleson to facilitate the development and construction of two restaurants and a building supply and garden center to be located in the City of Burleson In return, the City of Burleson has agreed to disannex a 0 747 acre tract of land which will then be annexed by the City of Fort Worth, and which will allow all of Alsbury Boulevard abutting the northern boundary of the development to be located in the City of Fort Worth Attached hereto for the City Council's consideration is a copy of the proposed ordinance disannexing the 3 584 tract Printed on Recyded Paper cZty of Fort worth texas Mayor and Council Commun~cat~on DATE 12/17/96 RSF8R8NC8 NIIMS$R **G-11699 LO(i NAME 12ACRE PAtiB 2 of 2 sosJSC'r ORDINANCE PROVIDING FOR THE CHANGING OF A PORTION OF THE CORPORATE BOUNDARIES OF THE CITIES OF FORT WORTH AND BURLESON BY DISANNEXING FROM FORT WORTH A 3.584 ACRE TRACT OF LAND LOCATED IN THE SARAH GRAY SURVEY, ABSTRACT NO 558, CITIES OF FORT WORTH AND BURLESON, TARRANT COUNTY, TEXAS FISCAL INFORMATION/CERTIFICATION..
