HomeMy WebLinkAboutOrdinance 12405i ORDINANCE NO ~~~ AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO 3011, AS AMENDED, CODIFIED AS APPENDIX "A" OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY AMENDING SECTION 1, "DEFINITIONS", BY AMENDING THE DEFINITIONS OF "MOBILE HOME", "MOBILE HOME PARK", "RECREATIONAL VEHICLE" AND "RECREATIONAL VEHICLE PARK" AND ADDING DEFINITIONS OF "HUD-CODE MANUFACTURED HOME", "MANUFACTURED HOME" AND "MOBILE HOME SUBDIVISION'; AMENDING SECTION 2-C, "'MH' MOBILE HOME DISTRICT', CONCERNING THE REGULATION OF MOBILE HOME PARKS AND MOBILE HOME SUBDIVISIONS, AMENDING SECTIONS 9 A.49, 20 C 31, AND 2-F.A.E.III Y CONCERNING RECREATIONAL VEHICLE PARKS TO REVISE REFERENCES TO THE CITY'S CODES REGULATING MOBILE HOME AND RECREATIONAL VEHICLE PARKS, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING A .PENALTY CLAUSE, PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER, AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Code of the City of Fort Worth (1986), as amended, was amended by the City Council of the City of Fort Worth by the adoption of Ordinance No 12264 on November 21, 1995, WHEREAS, Ordinance No 12264 amended Chapter 13 of the Code of the City of Fort Worth, "Fire Prevention and Protection," Article I, "In General", Section 13 2, "Same- Amendments," Subsection (b), "Fire Code", by the addition of a new Appendix Vlll, "Mobile Home and Recreational Vehicle Parks", providing standards for mobile home parks and recreational vehicle parks, WHEREAS, it is advisable to amend the Comprehensive Zoning Ordinance of the City of Fort Worth, Ordinance No 3011, as amended, codified as Appendix "A" of the Code of the City of Fort Worth (1986), as amended, in order to make the Zoning Ordinance consistent with Chapter 13, as amended, concerning mobile home parks and recreational vehicle parks, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 Section 1, "Definitions", of Ordinance No 3011, the Comprehensive Zoning Ordinance of the City of Fort Worth, as amended, is hereby amended by adding definitions of "HUD-code manufactured home", "manufactured home" and "mobile home subdivision" and amending the definitions of "mobile home", "mobile home park", "recreational vehicle" and "recreational vehicle park", as follows HUD-CODE MANUFACTURED HOME. A structure, constructed on or after June 15, 1976, according to the rules of the United States Department of Housing and Urban Development, transportable in one or more sections, which, in the traveling mode, is eight (8) body feet or more in width or 40 body feet or snore in length, or, when erected on site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air-conditioning, and electrical systems. The term does not include a recreational vehicle as that term is defined by 24 CFR § 3282 8(g) MANUFACTURED HOME. A HUD-code manufactured home or a mobile home and collectively means and refers to both. MOBILE HOME. A structure that was constructed before June 15, 1976, transportable in one or more sections, which, in the traveling mode, is eight (8) body feet or more in width or 40 body feet or more in length, or, when erected on site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air- condit~oning, and electrical systems. MOBILE HOME PARK. A unified development of lots arranged on a tract of Land under common ownership, which has been planned and improved for the placement of two (2) or more manufactured homes for nontransient occupancy For purposes -2- of this definition only, a "lot" means a plot of ground within a mobile home park which is designed to accommodate one (1}manufactured home MOBILE HOME SUBDIVISION A unified development of lots for the placement of one (1) manufactured home per platted lot for nontransient occupancy, established for the purpose of having individually owned lots RECREATIONAL VEHICLE. A vehicle which is (a) built on a single chassis, (b) 400 square feet or less when measured at the largest horizontal projections, (c) self-propelled or permanently towable by motor vehicle or light duty truck; (d) designed primarily not for use as permanent dwelling but as temporary living quarters for recreational, camping, travel, or seasonal use, and (e) required by Texas law to have a valid vehicle registration when traveling upon public streets. "Recreational vehicle" shall not include a manufactured home RECREATIONAL VEHICLE PARK. A unified development on a tract of land under common ownership designed primarily for transient service, on which recreational vehicles of the general public are parked or situated. SECTION 2. Section 2-C, "'MH' Mobile Home District", of Ordinance No 3011, the Comprehensive Zoning Ordinance of the City of Fort Worth, as amended, is hereby amended, as follows It is the purpose of the "MH" Mobile Home District to provide a specific zone for mobile home parks and mobile home subdivisions only, thus providing a location for the use and enjoyment of mobile homes along with those uses customarily incidental thereto A. USE REGULATIONS In the "MH'' Mobile Home District, no building or land shall be used except as follows Mobile home parks constructed and developed in accordance with Chapter 13 of the Code of the City of Fort Worth, "Fire Prevention and Protection," Article I, Section 13-2, Subsection (b), Appendix VIII, "Mobile Home and Recreational Vehicle Parks" -3- 2. Mobile home subdivisions, which shall contain a minimum land area of four (4) acres 3 Accessory uses and buildings 4 Special exception uses when authorized by the Board of Adjustment under the provisions of Section 20 B DEVELOPMENT REGULATIONS FOR MOBILE HOME PARKS Mobile home parks shall. be subject to all regulations and requirements concerning height, area, yard and parking set out in Chapter 13 of the Code of the City of Fort Worth, "Fire Prevention and Protection," Article I, Section 13-2, Subsection (b), Appendix VIII, "Mobile Home and Recreational Vehicle Parks" 2. Signs: An identifying sign shall be permitted at each major entrance to the mobile home park except that no more than three (3) signs shall be permitted for one park, and such signs shall be subject to the following provisions a. Each sign shall contain only the identifying name of the park and its street address b Signs may be illuminated but the source of light shall not be visible and shall not be intermittent or flashing; revolving signs shall not be permitted. Signs shall not be lighted between the hours of 10.00 p m and 6.00 a.m c. Such signs may be freestanding but shall 'have not more than two (2) supports and the top of the sign shall be no more than eight (8) feet above grade d Each sign shall be single-faced and shall be limited to a maximum area of twelve (12) square feet. e , All signs shall conform with the requirements concerning setbacks from public streets that are applicable to structures, except that such signs may be attached flat against a wall or fence surrounding the mobile home park, no portion of which shall extend into the public right-of-way -4- C DEVELOPMENT REGULATIONS FOR MOBILE HOME SUBDIVISIONS All construction of buildings or other structures in mobile home subdivisions shall conform to the following regulations. 1 Hei ht: Maximum thirty-five (35) feet. 2 Front Yard: Minimum twenty (20) feet. 3 Rear Yard: Minimum five (5) feet. 4 Side Yard (a) Interior Lot: Minimum five (5) feet. (b) Corner Lot: Minimum ten (10) feet adjacent to side street unless front yard setback required. 5 Width of Lot: Minimum forty (40) feet. 6 Lot Area Per Manufactured Home Unit: Minimum four thousand (4000} square feet. 7 Lot Coverage Maximum 0 50 or fifty (50) per cent. 8 No more than one dwelling. unit may be located on any one subdivision lot. D SPECIAL REGULATIONS 1 No manufactured home shall be located within the City of Fort Worth except in a mobile home park or a mobile home subdivision, except as permitted by the Board of Adjustment as a special exception use in accordance with Section 20 2 Recreational vehicles shall not be occupied as living quarters 3 Manufactured home sales lots shall not be permitted in the "MH" Mobile Home District. 4 Skirting shall be required on all manufactured homes 5 All manufactured homes shall be anchored to a permanent foundation -5- SECTION 3 Section 9, "'E' Commercial District", of Ordinance No 3011, the Comprehensive Zoning Ordinance of the City of Fort Worth, as amended, Subsection A, is hereby amended by replacing a reference to Ordinance No 6293 with a reference to Chapter 13 of the Code of the City of Fort Worth, "Fire Prevention and Protection," Article I, Section 13-2, Subsection (b), "Fire Code", Appendix VIII, "Mobile Home and Recreational Vehicle Parks", as follows. 49 Recreational vehicle parks, provided they are constructed and developed in conformance with Chapter 13 of the Code of the City of Fort Worth, "Fire Prevention and Protection," Article I, Section 13-2, Subsection (b), Appendix VIII, "Mobile Home and Recreational Vehicle Parks" SECTION 4 Section 20, "Board of Adjustment", of Ordinance No 3011, the Comprehensive Zoning Ordinance of the City of Fort Worth, as amended, Subsection C, is hereby amended by replacing a reference to Ordinance No 6293 with a reference to Chapter 13 of the Code of the City of Fort Worth, "Fire Prevention and Protection," Article I, Section 13-2, Subsection (b), "Fire Code", Appendix VIII, "Mobile Home and Recreational Vehicle Parks", as follows 31 Recreational vehicle parks, provided they are constructed and developed in conformance with Chapter 13 of the Code of the City of Fort Worth, "Fire Prevention and Protection," Article I, Section 13-2, Subsection (b), Appendix Vltt, "Mobile Home and Recreational Vehicle Parks" -6- SECTION 5 Section 2-F, "'O-2' Flood Plain District", of Ordinance No 3011, the Comprehensive Zoning Ordinance of the City of Fort Worth, as amended, Subsection A.e iii, is hereby amended by replacing a reference to Ordinance No 6293 with a reference to Chapter 13 of the Code of the City of Fort Worth, "Fire Prevention and Protection," Article I, Section 13 2, Subsection (b), "Fire Code", Appendix VIII, "Mobile Home and Recreational Vehicle Parks", as follows y Recreational vehicle parks, provided they are constructed and developed in conformance with Chapter 13 of the Code of the City of Fort Worth, "Fire Prevention and Protection," Article I, Section 13-2, Subsection (b), Appendix Vltl, "Mobile Home and Recreational Vehicle Parks" SECTION 6 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed SECTION 7 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section. of this ordinance shall. be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by -~- the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 8 Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00} for each offense Each day that a violation is permitted to exist shall constitute a separate offense SECTION 9 All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No. 3011 or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts SECTION 10 The City Secretary of the City of Fort Worth, Texas, is hereby authorized to publish this ordinance in pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof, as provided in Chapter XXV, Section 3, of the Charter of the City of Fort Worth, Texas .g. SECTION 11 The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013, Texas Local Government Code. SECTION 12. This ordinance shall be in full #orce and effect from and after its passage and publication as required by law, and it is so ordained.
