AN ORDINANCE VACATING, ABANDONING, CLOSING AND
EXTINGUISHING A UTILITY EASEMENT MEASURING 6 FEET IN WIDTH
AND 828 FEET IN LENGTH, SITUATED ADJACENT TO LOTS 1
THROUGH 16, BLOCK 2, ECKSTINE ADDITION, TO THE CITY OF FORT
WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the utility easement measuring 6 feet in width and 828 feet in length, situated
adjacent to Lots 1 through 16, Block 2, Eckstine Addition as recorded in Plat Records of
Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto
and incorporated herein by reference be and the same is vacated, abandoned and
permanently closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated utility easement is hereby
released and shall revert to the adjacent owner as provided by law
SECTION 3.
That all ordinances or,parts of ordinances in conflict herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and effect from and after the
date of its passage, and it is so ordained.

RECOMMENDATION
It is recommended that the City Council adopt the attached Ordinances vacating the following
street right-of-way and utility easements
1) ECKSTINE CIRCLE a 5-foot wide street right-of-way, terminating in a cul-de-sac with
a radius of 100 feet, situated between Blocks 1 & 2, Eckstine Addition, as recorded
in the Plat Records, Tarrant County, Texas, and Tracts 9A & 10D, A Beard Survey,
Abstract No 137
2) UTILITY EASEMENT measuring 6 feet in width and 828 feet in length, situated
adjacent to Lots 1 thru 16, Block 2, Eckstine Addition, as
recorded in the Plat Records, Tarrant County, Texas, and
3) UTILITY EASEMENT measuring 10 feet in width and 493 5 feet in length, situated
adjacent to Lots 1 thru 16, Block' 1', Eckstine Addition, as
recorded in the Plat Records, T;~rrant County, Texas
DISCUSSION
Mr Garey Gilley, representing Mercantile Partners, owner of the subject property, has requested
that the above described street right-of-way and utility easements be vacated The subject street
and easements, acquired by dedication, contain no utility facilities Reviewing City departments
and private utility companies have raised no objections to this request This request is
recommended for approval by the City Plan Commission on July 24, 1996 A waiver of the
replat requirement has been requested of the Plan Commission
This request is located in COUNCIL DISTRICT 4
