AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SPECIAL ASSESSMENTS FUND 1N THE
AMOUNT OF $30,715.77 AND IN THE STREETS IMPROVEMENTS FUND IN
THE AMOUNT OF $30,715.77 FROM AVAILABLE FUNDS FOR THE PURPOSE
OF FUNDING THE RECONSTRUCTION OF CYPRESS STREET FROM
LANCASTER TO EL PASO; PROVIDING FOR A SEVERABILITY CLAUSE,
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL PRIOR ORDINANCES 1N CONFLICT HEREWITH, AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1995/96 and in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special
Assessments Fund in the amount of $30,715.77 and in the Streets Improvements Fund in the amount of $30,715.77
from available funds for the purpose of funding the reconstruction of Cypress Street from Lancaster to El Paso.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any
reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the
remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and
remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 12074 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict with
such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances
and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so
ordained.

RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached appropriation ordinance increasing estimated receipts and appropri-
ations by 530,715 77 in the Special Assessments Fund from available funds, and
2 Approve a 530,715 77 fund transfer for the property owners' share of construction costs
from the Special Assessments Fund to the Street Improvements Fund, and
3 Adopt the attached appropriations ordinance increasing estimated receipts and
appropriations by 530,715 77 in the Streets Improvements Fund from available funds, and
4 Authorize the City Manager to execute a contract with McClendon Construction Company,
Inc , in the amount of 5210,894 82 for the reconstruction of Cypress from EI Paso to
Lancaster and of Presidio from Cypress to Pine
DISCUSSIO-N
The reconstruction of Cypress Street from EI Paso to Lancaster and of Presidio from Cypress to
Pine were added to the Capital Improvement Program at the request of the Fort Worth
Transportation Authority (FWTA), which owns property adjoining both streets The FWTA is
participating in the cost of the construction by paying the full cost of constructing Presidio, and
the City is financing the paving of Cypress with assessments against adjoining properties which
are not owned by FWTA
On June 30, 1992 (M8tC BH-0099), the City Council held a benefit hearing and levied
assessments for this project
The street improvements will include the construction of standard concrete pavement, drive:wa.y
approaches, and sidewalks where shown on the plans
The project. was advertised on February 22 and 29, 1996 The following bids were received on

The Director of Fiscal Services certifies that upon completion of the transfer and adoption of the
attached appropriations ordinance, funds required for this project will be available in the current
capital budget, as appropriated, of the Street Improvements Fund
