HomeMy WebLinkAboutOrdinance 12618,,., ~ A Ordinance No.~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $100,000 00 FOR THE PURPOSE OF FUNDING THE DEPARTMENT OF ENVIltONMENTAL MANAGEMENT'S AIR POLLUTION CONTROL PROGRAM THROUGH A GRANT FROM THE U S. ENVIRONMENTAL PROTECTION AGENCY, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCII, OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1995-96 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $100,000 00 for the purpose of funding the Department of Environmental Management's Air Pollution Control Program through a grant from the U S. Environmental Protection Agency SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 12074 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY Late Adopted Effective City of Fort Worth, Texas Mayor and Council Communisation DATE REFERENCE NOIdBER LOG NAME PAGE 08/13/96 **G-11558 52AIRPOL 1 of 2 svsJECT ENVIRONMENTAL PROTECTION AGENCY AIR POLLUTION CONTROL GRANT APPLICATION FOR FY 96-97 RECOMMENDATION It is recommended that the City Council Authorize the City Manager to submit an application for, and accept if offered, a grant from the U S Environmental Protection Agency (EPA) for the Department of Environmental Management's Air Pollution Control program in an amount not to exceed 5100,000, and 2 Adopt the attached supplemental appropriation ordinance increasing appropriations by 5100,000 in the General Fund and decreasing the unreserved, undesignated fund balance of the General Fund by the same amount for interim financing of expenses pending execution of a grant with the EPA, and 3 Approve the transfer of 5100,000 from the General Fund, to the Grants Fund, and 4 Adopt the attached appropriations ordinance increasing estimated receipts and appropriation in the Grants Fund by 5100,000 from available funds, and 5 Apply indirect costs in accordance with the City's Administrative Regulation 3-15, applying the most recently approved rate of 28 43% for Environmental Management, not to exceed 522,137 DISCUSSION The EPA currently funds a portion of the City's Air Pollution Control program through a 5100,000 annual grant The City's Air Pollution Control Program, in cooperation with the Texas Natural Resource Conservation Commission, enforces the Federal and State Clean Air Act provisions within the city limits of Fort Worth This includes periodic inspection of specific emission sources, daily monitoring of ozone and particulate levels, and complaint investigation The EPA grant does require a local match The City's proposed General Fund budget for FY 1996-97 will include 5130,820 as matching funds for the Air Pollution Control program It is anticipated that the City will be reimbursed for over 51 % of these matching funds through service contracts with Tarrant County and the Texas Natural Resource Conservation Commission The interim funding of 5100,000 will be returned to the General Fund upon execution of a grant contract with the EPA Printed on Recyded Paper City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER **G-11558 LOG NAME PAGE 08/13/96 52AIRPOL 2 of 2 SUBJECT ENVIRONMENTAL PROTECTION AGENCY AIR POLLUTION CONTROL GRANT APPLICATION FOR FY 96-97 FISCAL INFORMATION/CERTIFICATION The Director of Fiscal Services certifies that upon execution of the grant agreement, approval of this transfer, and adoption of the attached appropriations ordinances, funds will be available, as appropriated, in the Grants Fund After completion of this transfer, the unreserved, undesignated fund balance of the General Fund will be 528,836,135 Upon execution of the grant agreement, the 5100,000 will be transferred back to General Fund MGf Submitted for City Manager's FUND ACCOUNT CENTER AMOUNT CITY SECRETARY Office by: (to) 2)GGO1 538070 0903500 $100,000 0o Ch l B ll 8511 3 4 GR76 APPP®~E® ar es oswe ) 472001 052214403000 $loo,ooo•oo . .
